{"data":{"id":"us-ky/krs-501.060","jurisdiction":"us-ky","citation":"KRS 501.060","heading":"Causal relationships.","body":"(1) Conduct is the cause of a result when it is an antecedent without which the result in\nquestion would not have occurred.\n(2) When intentionally causing a particular result is an element of an offense, the\nelement is not established if the actual result is not within the intention or the\ncontemplation of the actor unless:\n(a) The actual result differs from that intended or contemplated, as the case may\nbe, only in the respect that a different person or different property is injured or\naffected or that the i njury or harm intended or contemplated would have been\nmore serious or more extensive; or\n(b) The actual result involves the same kind of injury or harm as that intended or\ncontemplated and occurs in a manner which the actor knows or should know\nis rendered substantially more probable by his conduct.\n(3) When wantonly or recklessly causing a particular result is an element of an offense,\nthe element is not established if the actual result is not within the risk of which the\nactor is aware or, in the case of recklessness, of which he should be aware unless:\n(a) The actual result differs from the probable result only in the respect that a\ndifferent person or different property is injured or affected or that the probable\ninjury or harm would have been more s erious or more extensive than that\ncaused; or\n(b) The actual result involves the same kind of injury or harm as the probable\nresult and occurs in a manner which the actor knows or should know is\nrendered substantially more probable by his conduct.\n(4) The question of whether an actor knew or should have known the result he caused\nwas rendered substantially more probable by his conduct is an issue of fact.","path":["KRS Chapter 501"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19655","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"2d6a6fb95b81af2b6e381e628683433b94e39a6f0b969f49ed48afbeb3e27892","source_id":"us-ky","stale":false,"prev":"us-ky/krs-501.050","next":"us-ky/krs-501.070"},"notice":"GroundRules: Original legal text.
