{"data":{"id":"us-ky/krs-504.060","jurisdiction":"us-ky","citation":"KRS 504.060","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Department\" means the Department of Corrections;\n(2) \"Examiner\" means a psychologist or psychiatrist who examines, treats, or reports\non a defendant's mental condition as required by this chapter;\n(3) \"Forensic psychiatric facility\" means a mental institution or facility, or part thereof,\ndesignated by the secretary for the purpose and function of providing inpatient\nevaluation, care, and treatment for individuals with an intellectual disa bility or a\nmental illness who have been charged with or convicted of a felony;\n(4) \"Foreseeable future\" means not more than three hundred sixty (360) days;\n(5) \"Incompetency to stand trial\" means, as a result of mental condition, lack of\ncapacity to appre ciate the nature and consequences of the proceedings against one\nor to participate rationally in one's own defense;\n(6) \"Individual with an intellectual disability\" means an individual with significantly\nsubaverage general intellectual functioning existing  concurrently with deficits in\nadaptive behavior and manifested during the developmental period and is a\ncondition which may exist concurrently with mental illness or insanity;\n(7) \"Insanity\" means, as a result of mental illness or intellectual disability,  lack of\nsubstantial capacity to appreciate the nature and quality of one's conduct;\n(8) \"Mental illness\" means substantially impaired capacity to use self -control,\njudgment, or discretion in the conduct of one's affairs and social relations,\nassociated wi th maladaptive behavior or recognized emotional symptoms where\nimpaired capacity, maladaptive behavior, or emotional symptoms can be related to\nphysiological, psychological, or social factors;\n(9) \"Psychiatrist\" means a physician licensed pursuant to KRS C hapter 311 who is\ncertified or eligible to apply for certification by the American Board of Psychiatry\nand Neurology, Inc.;\n(10) \"Psychologist\" means a person licensed at the doctoral level pursuant to KRS\nChapter 319 who has been designated by the Kentucky Board of Examiners of\nPsychology as competent to perform examinations;\n(11) \"Secretary\" means the secretary of the Cabinet for Health and Family Services;\n(12) \"Treatment\":\n(a) Means medication or counseling, therapy, psychotherapy, and other\nprofessional services provided by or at the direction of psychologists or\npsychiatrists; and\n(b) Shall not include electroshock therapy or psychosurgery; and\n(13) \"Treatment facility\" means an institution or part thereof, approved by the Cabinet\nfor Health and Family Services, which provides evaluation, care, and treatment for\ninsane or individuals with an intellectual disability or a mental i llness on an\ninpatient or outpatient basis.","path":["KRS Chapter 504"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57186","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"6ab01c43d1e605386e4f3bc627262279a30e85e7f45835a01f190e8bb553cc4a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-504.050","next":"us-ky/krs-504.070"},"notice":"GroundRules: Original legal text.
