{"data":{"id":"us-ky/krs-504.100","jurisdiction":"us-ky","citation":"KRS 504.100","heading":"Appointment by court of psychologist or psychiatrist during proceedings.","body":"(1) If upon arraignment, or during any stage of the proceedings, the court has\nreasonable grounds to believe the defendant is incompetent to stand trial, the court\nshall order the defendant to be examined and his or her mental condition reported,\nas provided in KRS 504.080.\n(2) The report of the examiner shall state whether or not he or she finds the defendant\nincompetent to stand trial. If the examiner finds the defenda nt is incompetent, the\nreport shall state:\n(a) Whether there is a substantial probability of the defendant attaining\ncompetency in the foreseeable future; and\n(b) What type treatment the examiner recommends, including whether it should\nbe provided by a treatment facility or forensic psychiatric facility.\n(3) In accordance with KRS 504.080(2), the court shall schedule the case for a status\nconference or a hearing no more than thirty (30) days after the filing of the report.","path":["KRS Chapter 504"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55103","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"45d6259bc2adbec331d5f078c2d1b883f1b816691a106d45bb4b35113d82a662","source_id":"us-ky","stale":false,"prev":"us-ky/krs-504.090","next":"us-ky/krs-504.110"},"notice":"GroundRules: Original legal text.
