{"data":{"id":"us-ky/krs-506.010","jurisdiction":"us-ky","citation":"KRS 506.010","heading":"Criminal attempt.","body":"(1) A person is guilty of criminal attempt to commit a crime when, acting with the kind\nof culpability otherwise required for commission of the crime, he or she:\n(a) Intentionally engages in conduct which would constitute the crime if the\nattendant circumstances were as he or she believes them to be; or\n(b) Intentionally does or omits to do anything which, under the circumstances as\nhe or she believes them to be, is a substantial step in a course of conduct\nplanned to culminate in his commission of the crime.\n(2) Conduct shall not be held to constitute a substantial step under subsection (1)(b) of\nthis section unless it is an act or omission which leaves no reasonable doubt as to\nthe defendant's intention to commit the crime which he or she is charged with\nattempting.\n(3) A person is guilty of criminal attempt to commit a crime when he engages in\nconduct intended to aid another person to commit that crime, although the crime is\nnot committed or attempted by the other person, provided that his or her conduct\nwould establish complicity under KRS 502.020 if the crime were committed by the\nother person.\n(4) A criminal attempt is a:\n(a) Class C felony when the crime attempted is a violation of KRS 521.020 or\n521.050;\n(b) Class B felony when the crime attempted is a Cla ss A felony or capital\noffense;\n(c) Class C felony when the crime attempted is a Class B felony;\n(d) Class A misdemeanor when the crime attempted is a Class C or D felony; or\n(e) Class B misdemeanor when the crime attempted is a misdemeanor.\n(5) Notwithstanding KRS Chapter 532, a person who has been convicted of, or entered\na plea of guilty or nolo contendere to, criminal attempt to commit murder of a first\nresponder shall be sentenced to imprisonment for:\n(a) At least twenty (20) years;\n(b) Life; or\n(c) Life without benefit of probation or parole until the person has served a\nminimum of twenty-five (25) years.","path":["KRS Chapter 506"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55458","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"32e4e010b19d31aeb7c68a3f95fac2c14ca9ad6095b8462d9a43114647843a62","source_id":"us-ky","stale":false,"prev":"us-ky/krs-505.060","next":"us-ky/krs-506.020"},"notice":"GroundRules: Original legal text.
