{"data":{"id":"us-ky/krs-506.070","jurisdiction":"us-ky","citation":"KRS 506.070","heading":"Incapacity of solicitee or co-conspirator.","body":"(1) It is no defense to a prosecution for criminal solicitation that the person solicited\ncould not be guilty of the crime solicited because of:\n(a) Criminal irresponsibility or other legal incapacity or exemption; or\n(b) Unawareness of the criminal nature o f the conduct solicited or of the\ndefendant's criminal purpose; or\n(c) Any other factor precluding the mental state required for the commission of\nthe crime solicited.\n(2) It is no defense to a prosecution for criminal conspiracy that a co -conspirator could\nnot be guilty of the conspiracy or the crime contemplated by the conspiracy because\nof:\n(a) Criminal irresponsibility or other legal incapacity or exemption; or\n(b) Unawareness of the criminal nature of the conspiracy or the conduct\ncontemplated by the conspiracy or of the defendant's criminal purpose; or\n(c) Any other factor precluding the mental state required for the commission of\nthe conspiracy or the crime contemplated by the conspiracy.\n(3) A defendant cannot be convicted of conspiracy if all of his co -conspirators have\nbeen acquitted or discharged under circumstances amounting to an acquittal.","path":["KRS Chapter 506"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19707","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"09e815dda12305898d86d992287d064b2766de8ac3bacc8915b6b9f741d96529","source_id":"us-ky","stale":false,"prev":"us-ky/krs-506.060","next":"us-ky/krs-506.080"},"notice":"GroundRules: Original legal text.
