{"data":{"id":"us-ky/krs-506.135","jurisdiction":"us-ky","citation":"KRS 506.135","heading":"Definitions for chapter.","body":"As used in this chapter:\n(1) \"Criminal gang\" means any alliance, network, conspiracy, or group that:\n(a) Consists of three (3) or more persons who have any of the following in\ncommon:\n1. Name;\n2. Identifying hand signal or sign;\n3. Colors;\n4. Symbols;\n5. Geographical location; or\n6. Leader;\n(b) Has been identified or prosecuted as a gang by the Commonwealth, or another\nstate or any federal law enforcement agency; and\n(c) Has two (2) or more members who, individually or collectively, through its\nmembers or actions of its members engage  in or have engaged in a pattern of\ncriminal activity.\n\"Criminal gang\" does not include fraternal organizations, unions, corporations,\nassociations, or similar entities, unless organized for the primary purpose of\nengaging in criminal activity; and\n(2) \"Pattern of criminal gang activity\" means acts performed on separate occasions\nwithin a five (5) year period by any member or members of a criminal gang for the\ncommission, attempt, or solicitation of, or conspiracy to commit:\n(a) Two (2) or more felony offenses;\n(b) Three (3) or more of the misdemeanor offenses enumerated in KRS 506.160;\nor\n(c) A combination of at least:\n1. One (1) felony offense; and\n2.
