{"data":{"id":"us-ky/krs-506.140","jurisdiction":"us-ky","citation":"KRS 506.140","heading":"Criminal gang recruitment.","body":"(1) (a) Any person who is age eighteen (18) or older is guilty of criminal gang\nrecruitment in the first degree if he or she:\n1. Solicits or entices any person under the age of fifteen (15) to join a\ncriminal gang; and\n2. Requires as a condition of membership the commission of a crime.\n(b) Criminal gang recruitment in the first degree is a Class C felony for the first\noffense and a Class B felony for a second or subsequent offense.\n(2) (a) Any person over the age of eighteen (18) is guilty of criminal gang\nrecruitment in the second degree if he or she entices or solicits another person\nto join a criminal gang or intimidates or threatens another person because the\nother person:\n1. Refuses to join a criminal gang;\n2. Has withdrawn or is attempting to withdraw from a criminal gang; or\n3. Refuses to submit to a demand made by a criminal gang.\n(b) Criminal gang recruitment in the second degree is a Class D felony for the\nfirst offense and a Class C felony for a second or subsequent offense.\n(3) (a) Any person under the  age of eighteen (18) is guilty of criminal gang\nrecruitment in the third degree when he or she intentionally encourages or\nsolicits another person to join a criminal gang.\n(b) Criminal gang recruitment in the third degree is a Class A misdemeanor for\nthe first offense and a Class D felony for a second or subsequent offense.\n(4) It shall be no defense to prosecution under this section that the other person never\nintended to or did not commit the crime.","path":["KRS Chapter 506"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47301","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:00Z","sha256":"e65d2d34f1167087892620633caf7231c18b263a39fc47ef389b8b48991ad0e1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-506.135","next":"us-ky/krs-506.150"},"notice":"GroundRules: Original legal text.
