{"data":{"id":"us-ky/krs-507a.010","jurisdiction":"us-ky","citation":"KRS 507A.010","heading":"Definitions -- Exceptions.","body":"(1) As used in this chapter:\n(a) \"Abortion\" has the same meaning as in KRS 311.720;\n(b) \"Health care provider\" has the same meaning as in KRS 304.17A-005; and\n(c) \"Unborn child\" means a member of the species homo sapiens in utero from\nconception onward, without regard to age, health, or condition of dependency.\n(2) In a prosecution for the death of an unborn child, nothing in this chapter shall apply\nto acts performed by or at the direction of a health care provider that cause the death\nof an unborn child if those acts were committed:\n(a) During any abortion for which the consent of the pregnant woman has been\nobtained or for which the consent is implied by law in a medical emergency;\nor\n(b) As part of or incident to diagnostic testing or therapeutic medical or fertility\ntreatment, provided that the acts were performed with that degree of care and\nskill which an ordinarily careful, skilled, and prudent health care provider or a\nperson acting under the provider's direction would exercise under the same or\nsimilar circumstances.\n(3) Nothing in this chapter shall apply to any acts of a pregnant woman that caused the\ndeath of her unborn child.","path":["KRS Chapter 507A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19721","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:01Z","sha256":"4baf19df86bdbe039c12ab58eb1c0e62f4f17b67a0a38ea8279cee731ac59b97","source_id":"us-ky","stale":false,"prev":"us-ky/krs-507.070","next":"us-ky/krs-507a.020"},"notice":"GroundRules: Original legal text.
