{"data":{"id":"us-ky/krs-507a.020","jurisdiction":"us-ky","citation":"KRS 507A.020","heading":"Fetal homicide in the first degree.","body":"(1) A person is guilty of fetal homicide in the first degree when:\n(a) With intent to cause the death of an unborn child or with the intent necessary\nto commit an offense under KRS 507.020(1)(a), he causes the death of an\nunborn child; except that in any prosecution, a person shall not be guilty under\nthis subsection if he acted under the influence of extreme emotional\ndisturbance for which there was a reasonable explanation or excuse, the\nreasonableness of which is to be determined from the viewpoint of a pers on in\nthe defendant's situation under the circumstances as the defendant believed\nthem to be. However, nothing contained in this section shall constitute a\ndefense to a prosecution for or preclude a conviction of fetal homicide in the\nsecond degree or any other crime; or\n(b) Including but not limited to the operation of a motor vehicle under\ncircumstances manifesting extreme indifference to human life, he wantonly\nengages in conduct which creates a grave risk of death to an unborn child and\nthereby causes the death of an unborn child.\n(2) Fetal homicide in the first degree is a capital offense.","path":["KRS Chapter 507A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19722","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:01Z","sha256":"b1768de7d2362d60e3a784021c8f8622f506e3c96d70f898a3293eb67447e924","source_id":"us-ky","stale":false,"prev":"us-ky/krs-507a.010","next":"us-ky/krs-507a.030"},"notice":"GroundRules: Original legal text.
