{"data":{"id":"us-ky/krs-510.110","jurisdiction":"us-ky","citation":"KRS 510.110","heading":"Sexual abuse in the first degree.","body":"(1) A person is guilty of sexual abuse in the first degree when:\n(a) He or she subjects another person to sexual contact by forcible compulsion; or\n(b) He or she subjects another person to sexual contact who is incapable of\nconsent because he or she:\n1. Is physically helpless;\n2. Is less than twelve (12) years old;\n3. Is mentally incapacitated; or\n4. Is an individual with an intellectual disability; or\n(c) Being twenty-one (21) years old or more, he or she:\n1. Subjects another person who is less than sixteen (1 6) years old to sexual\ncontact;\n2. Engages in masturbation in the presence of another person who is less\nthan sixteen (16) years old and knows or has reason to know the other\nperson is present; or\n3. Engages in masturbation while using the Internet, teleph one, or other\nelectronic communication device while communicating with a minor\nwho the person knows is less than sixteen (16) years old, and the minor\ncan see or hear the person masturbate; or\n(d) Being a person in a position of authority or position of special trust, as defined\nin KRS 532.045, he or she, regardless of his or her age, subjects a minor who\nis less than eighteen (18) years old, with whom he or she comes into contact\nas a result of that position, to sexual contact or engages in masturbation in  the\npresence of the minor and knows or has reason to know the minor is present\nor engages in masturbation while using the Internet, telephone, or other\nelectronic communication device while communicating with a minor who the\nperson knows is less than sixteen (16) years old, and the minor can see or hear\nthe person masturbate.\n(2) Sexual abuse in the first degree is a Class D felony, unless the victim is less than\ntwelve (12) years old, in which case the offense shall be a Class C felony.","path":["KRS Chapter 510"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47887","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:01Z","sha256":"62a5e49117e6e56cb6f03fb29b3ad61e871b160eb9a397a50ea11e43cf5d07fe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-510.100","next":"us-ky/krs-510.120"},"notice":"GroundRules: Original legal text.
