{"data":{"id":"us-ky/krs-511.085","jurisdiction":"us-ky","citation":"KRS 511.085","heading":"Domestic violence shelter trespass.","body":"(1) As used in this section, \"domestic violence shelter\" means a residential facility\nproviding protective shelter services for domestic violence victims.\n(2) A person is guilty of domestic violence shelter trespass when:\n(a) The person enters the buildings or premises of a domestic violence shelter that\nthe person knows or should know is a domestic violence shelter or which is\nclearly marked on the building or premises as being a domestic violence\nshelter; and\n(b) At the time of the entering, the person is the  subject of an order of protection\nas defined in KRS 403.720 and 456.010.\n(3) It shall be a defense to a prosecution under this section that the person entered the\nshelter with the permission of the operator of the shelter after disclosing to the\noperator that the person is the subject of an order of protection or a foreign\nprotective order. Authority to enter under this subsection may not be granted by a\nperson taking shelter at the facility.\n(4) A person shall not be convicted of a violation of this section and a violation of KRS\n511.060, 511.070, or 511.080 arising from the same act of trespass.\n(5) Domestic violence shelter trespass is a Class A misdemeanor.","path":["KRS Chapter 511"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44796","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"47822461cb87aabcb21c786e30c016f657fa3cf834b21e27a01cd2b6cb2b1be5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-511.080","next":"us-ky/krs-511.090"},"notice":"GroundRules: Original legal text.
