{"data":{"id":"us-ky/krs-511.090","jurisdiction":"us-ky","citation":"KRS 511.090","heading":"General provisions.","body":"(1) A person \"enters or remains unlawfully\" in or upon premises when he is not\nprivileged or licensed to do so.\n(2) A person who, regardless of his intent, enters or remains in or upon premises which\nare at the time open to the public does so with license or p rivilege unless he defies a\nlawful order not to enter or remain personally communicated to him by the owner of\nsuch premises or other authorized person.\n(3) A license or privilege to enter or remain in or upon premises which are only partly\nopen to the public is not a license or privilege to enter or remain in or upon a part of\nthe premises which is not open to the public.\n(4) A person who enters or remains upon unimproved and apparently unused land\nwhich is neither fenced nor otherwise enclosed does not co mmit criminal trespass\nunless notice against trespass is personally communicated to him by the owner of\nthe land or some other authorized person or unless notice is given by posting in a\nconspicuous manner.\n(5) Private land adjoining a railtrail that is ne ither fenced nor otherwise enclosed shall\nbe presumed to be land where notice against trespassing has been given by the\nowner of the land, and a person utilizing the railtrail shall be presumed to lack\nprivilege or license to enter upon that land unless the person has permission from an\nadjoining landowner to do so.","path":["KRS Chapter 511"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19788","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"73f62141a1d138c844904807d95aa7838229e1ff7bcd7fb07f1abc50077f4937","source_id":"us-ky","stale":false,"prev":"us-ky/krs-511.085","next":"us-ky/krs-511.100"},"notice":"GroundRules: Original legal text.
