{"data":{"id":"us-ky/krs-514.010","jurisdiction":"us-ky","citation":"KRS 514.010","heading":"Definitions.","body":"The following definitions apply in this chapter unless the context otherwise requires:\n(1) \"Deprive\" means:\n(a) To withhold property of another permanently or for so extended a period as to\nappropriate a major portion of its economic value or with intent to restore only\nupon payment of reward or other compensation; or\n(b) To dispose of the property so as to make it unlikely that the owner will\nrecover it.\n(2) \"Financial institution\" means a bank, insurance company, credit union, building and\nloan associatio n, savings and loan association, investment trust or other\norganization held out to the public as a place of deposit of funds or medium of\nsavings or collective investment.\n(3) \"Movable property\" means property the location of which can be changed, including\nthings growing on, affixed to, or found in land, and documents although the rights\nrepresented thereby have no physical location. \"Immovable property\" is all other\nproperty.\n(4) \"Obtain\" means:\n(a) In relation to property, to bring about a transfer or p urported transfer from\nanother person of a legal interest in the property, whether to the obtainer or\nanother; or\n(b) In relation to labor or service, to secure performance thereof.\n(5) \"Propelled vehicle\" means any vehicle, including but not limited to mo tor vehicles,\naircraft, boats, or construction machinery, which is propelled otherwise than by\nmuscle power or which is readily capable of being towed otherwise than by muscle\npower.\n(6) \"Property\" means anything of value, including real estate, tangible a nd intangible\npersonal property, contract rights, documents, choses-in-action and other interests in\nor claims to wealth, admission or transportation tickets, captured or domestic\nanimals, food and drink.\n(7) \"Property of another\" includes property in which any person other than the actor has\nan interest which the actor is not privileged to infringe, regardless of the fact that\nthe actor also has an interest in the property and regardless of the fact that the other\nperson might be precluded from civil recov ery because the property was used in an\nunlawful transaction or was subject to forfeiture as contraband. Property in\npossession of the actor shall not be deemed property of another who has only a\nsecurity interest therein, even if legal title is in the creditor pursuant to a conditional\nsales contract or other security arrangement.\n(8) \"Receiving\" means acquiring possession, control or title or lending on the security\nof the property.\n(9) \"Services\" includes labor, professional service, transportation, telephone, electricity,\ngas, water or other public service, accommodation in hotels, restaurants or\nelsewhere, admission to exhibitions, use of vehicles or other movable property.\n(10) \"Tax liability\" for purposes of this chapter means the amount of money by which a\nperson understates the total amount of taxes due or collected and not remitted to the\nCommonwealth, or the amount he fails to pay to the state, or both. Any person\nwhose income is subject to the withholding of income tax and from whose income\ntaxes are withheld shall be considered, for purposes of this chapter, to have paid to\nthe Commonwealth the sum of money withheld, whether or not such sum withheld\nis paid to the Commonwealth.\n(11) \"Tax return\" means any return, declaration, report or form issued or prescribed by\nthe Department of Revenue and required to be filed with the Department of\nRevenue as prescribed by law.","path":["KRS Chapter 514"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19802","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"887dba52cd5f5c979e57cc531da582cd1888aa948c622345ec36fb89eaba099b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-513.060","next":"us-ky/krs-514.020"},"notice":"GroundRules: Original legal text.
