{"data":{"id":"us-ky/krs-514.050","jurisdiction":"us-ky","citation":"KRS 514.050","heading":"Theft of property lost, mislaid, or delivered by mistake.","body":"(1) Except as provided in KRS 365.710, a person is guilty of theft of property lost,\nmislaid, or delivered by mistake when:\n(a) He or she comes into control of the property of another that he or she knows\nto have been lost, mislaid, or delivered under a mistak e as to the nature or\namount of the property or the identity of the recipient; and\n(b) With intent to deprive the owner thereof, he or she fails to take reasonable\nmeasures to restore the property to a person entitled to have it.\n(2) Theft of property lost , mislaid, or delivered by mistake is a Class B misdemeanor\nunless:\n(a) The value of the property is five hundred dollars ($500) or more but less than\none thousand dollars ($1,000), in which case it is a Class A misdemeanor;\n(b) The value of the property i s one thousand dollars ($1,000) or more but less\nthan ten thousand dollars ($10,000), in which case it is a Class D felony;\n(c) A person has three (3) or more convictions under paragraph (a) of this\nsubsection within the last five (5) years, in which case it is a Class D felony.\nThe five (5) year period shall be measured from the dates on which the\noffenses occurred for which the judgments of conviction were entered; or\n(d) The value of the property is ten thousand dollars ($10,000) or more, in which\ncase it is a Class C felony.\n(3) If any person commits two (2) or more separate offenses of theft of property lost,\nmislaid, or delivered by mistake within ninety (90) days, the offenses may be\ncombined and treated as a single offense, and the value of the prope rty in each\noffense may be aggregated for the purpose of determining the appropriate charge.","path":["KRS Chapter 514"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51039","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"d064bd33da8bcbfeebcbbc53bf65387d6e40f72bb8dcbc120f0798e27e50ce3f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-514.040","next":"us-ky/krs-514.060"},"notice":"GroundRules: Original legal text.
