{"data":{"id":"us-ky/krs-514.090","jurisdiction":"us-ky","citation":"KRS 514.090","heading":"Theft of labor already rendered.","body":"(1) A person is guilty of theft of labor already rendered when, in payment of labor\nalready rendered by another, he or she intentionally issues or passes a check or\nsimilar sight order for the payment of money, knowing that it will not be honored by\nthe drawee.\n(2) For purposes of subsection (1) of this section, an issuer of a check or similar sight\norder for the payment of money is presumed to know that the check or order, other\nthan a postdated check or order, would not be paid, if:\n(a) The issuer had no acco unt with the drawee at the time the check or order was\nissued; or\n(b) Payment was refused by the drawee for lack of funds, upon presentation\nwithin thirty days (30) after issue, and the issuer failed to make good within\nten (10) days after receiving notice of that refusal.\n(3) Theft of labor already rendered is a Class B misdemeanor unless:\n(a) The value of the labor rendered is five hundred dollars ($500) or more but less\nthan one thousand dollars ($1,000), in which case it is a Class A\nmisdemeanor;\n(b) The value of the labor rendered is one thousand dollars ($1,000) or more but\nless than ten thousand dollars ($10,000), in which case it is a Class D felony;\n(c) A person has three (3) or more convictions under paragraph (a) of this\nsubsection within the last  five (5) years, in which case it is a Class D felony.\nThe five (5) year period shall be measured from the dates on which the\noffenses occurred for which the judgments of conviction were entered; or\n(d) The value of the labor rendered is ten thousand dolla rs ($10,000) or more, in\nwhich case it is a Class C felony.\n(4) If any person commits two (2) or more separate offenses of theft of labor already\nrendered within ninety (90) days, the offenses may be combined and treated as a\nsingle offense, and the value of the property in each offense may be aggregated for\nthe purpose of determining the appropriate charge.","path":["KRS Chapter 514"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"3c3abc21b8423f552217baca9d8a05c69c744c42f96b9080135bdc77eac87d99","source_id":"us-ky","stale":false,"prev":"us-ky/krs-514.080","next":"us-ky/krs-514.100"},"notice":"GroundRules: Original legal text.
