{"data":{"id":"us-ky/krs-514.160","jurisdiction":"us-ky","citation":"KRS 514.160","heading":"Theft of identity.","body":"(1) A person is guilty of the theft of the identity of another when he or she knowingly\npossesses or uses any current or former identifying information of the other person\nor family member or ancestor of the other person, such as that person's or family\nmember's or ancestor's name, address, telephone number, electronic mail address,\nSocial Security number, driver's license number, birth date, personal identification\nnumber or code, and any other information which could be used to identify the\nperson, including unique biometric data, with the intent to represent that he or she is\nthe other person for the purpose of:\n(a) Depriving the other person of property;\n(b) Obtaining benefits or property to which he or she would otherwise not be\nentitled;\n(c) Making financial or credit transactions using the other person's identity;\n(d) Avoiding detection; or\n(e) Commercial or political benefit.\n(2) Theft of identity is a Class D felony. If the person violating this section is a business\nthat has violated this section on mor e than one (1) occasion, then that person also\nviolates the Consumer Protection Act, KRS 367.110 to 367.300.\n(3) This section shall not apply when a person obtains the identity of another to\nmisrepresent his or her age for the purpose of obtaining alcoholi c beverages,\ntobacco, or another privilege denied to minors.\n(4) This section does not apply to credit or debit card fraud under KRS 434.550 to\n434.730.\n(5) Where the offense consists of theft by obtaining or trafficking in the personal\nidentity of another person, the venue of the prosecution may be in either the county\nwhere the offense was committed or the county where the other person resides.\n(6) A person found guilty of violating any provisions of this section shall forfeit any\nlawful claim to the identifying information, property, or other realized benefit of the\nother person as a result of such violation.","path":["KRS Chapter 514"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19818","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:02Z","sha256":"e8392d77c6551dc9d31d8a7e7b11c8dea3def893bdcece885628d514adf74251","source_id":"us-ky","stale":false,"prev":"us-ky/krs-514.150","next":"us-ky/krs-514.170"},"notice":"GroundRules: Original legal text.
