{"data":{"id":"us-ky/krs-519.010","jurisdiction":"us-ky","citation":"KRS 519.010","heading":"Definitions for chapter.","body":"The following definitions apply in this chapter unless the context otherwise requires:\n(1) \"Benefit\" means gain or advantage to the beneficiary or to a third person pursuant to\nthe desire or consent of the beneficiary;\n(2) \"Emergency response\" means a resp onse by two (2) or more first responders to a\nreported incident that:\n(a) Is of such an emergent nature that the exemptions provided under KRS\n189.940 would apply; and\n(b)  Jeopardizes or could jeopardize public safety;\n(3) \"First responder\" means:\n(a) Peace officer;\n(b) Fire personnel;\n(c) Paid or volunteer emergency medical services personnel certified or licensed\npursuant to KRS Chapter 311A; or\n(d) Private not -for-profit organization personnel providing fire, rescue, or\nemergency medical services;\n(4) \"Governmental function\" means any activity which a public servant is legally\nauthorized to undertake on behalf of the governmental unit which he or she serves;\n(5) \"Public record\" includes all books, papers, maps, photographs, cards, tapes, discs,\ndiskettes, recordings, magnetic or electronic images, optical images or other\ndocumentary materials regardless of physical form or characteristics, which are\nprepared, owned, used, in the possession of, received or retained by a public agency.\n\"Public record\" shall  not include any records owned by a private person or\ncorporation that are not related to functions, activities, programs, or operations\nfunded by state or local authority; and\n(6) \"Public servant\" means:\n(a) Any public officer or employee of the state or of any political subdivision\nthereof or of any governmental instrumentality within the state;\n(b) Any person exercising the functions of any public officer or employee;\n(c) Any person participating as advisor,  consultant, or otherwise in performing a\ngovernmental function, but not including witnesses; or\n(d) Any person elected, appointed or designated to become a public servant\nalthough not yet occupying that position.","path":["KRS Chapter 519"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52929","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:03Z","sha256":"10a03fd353ca65ce4f5d4031dac6221479971212145f6a1673be4282df3eb2ba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-518.090","next":"us-ky/krs-519.020"},"notice":"GroundRules: Original legal text.
