{"data":{"id":"us-ky/krs-523.010","jurisdiction":"us-ky","citation":"KRS 523.010","heading":"Definitions.","body":"The following definitions apply in this chapter unless the context otherwise requires:\n(1) \"Material false statement\" means any false statement, regardless of its admissibility\nunder the rules of evidence which could have affected the outcome of the\nproceeding. Whether a falsification is material in a given factual situation is a\nquestion of law.\n(2) \"Oath\" means an affirmation or other legally authorized manner of attesting to the\ntruth of a statement. A written statement shall be treated as if made under oath\nwhen:\n(a) The statement was made on or pursuant to a form bearing notice, authorized\nby law, that false statements made therein are punishable; or\n(b) 1. The document recites that the statement was made under oath, and\n2. a. The declarant was aware of such recitation at the time he made the\nstatement;\nb. The declarant intended that the statement be represented as sworn;\nand\nc. The statement was in fact so represented by its delivery or\nutterance with the signed jurat of an officer, authorized to\nadminister oaths appended thereto.\n(3) \"Official proceeding\" means a proceeding heard before any legislative, judicial,\nadministrative or other governmental agency or official authorized to hear evidence\nunder oath, including any referee, hearing examiner, commi ssioner, notary or other\nperson taking testimony or depositions in any such proceedings.\n(4) \"Required or authorized by law\" means the oath is provided for by statute,\nregulation, court rule, or otherwise by law.\n(5) \"Statement\" means any repres entation, but includes a representation of opinion,\nbelief or other state of mind only if the representation clearly relates to state of mind\napart from or in addition to any facts which are the subject of the representation.\n(6) \"Public servant\" means:\n(a) Any public officer or employee of the state or of any political subdivision\nthereof or of any governmental instrumentality within the state; or\n(b) Any person exercising the functions of any such public officer or employee; or\n(c) Any person participatin g as advisor, consultant or otherwise in performing a\ngovernmental function, but not including witnesses; or\n(d) Any person elected, appointed or designated to become a public servant\nalthough not yet occupying that position.","path":["KRS Chapter 523"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19892","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:03Z","sha256":"6537ec793513d8005898e7f45d75695596c3e71c2c0e79d90fc4d45ee42b9741","source_id":"us-ky","stale":false,"prev":"us-ky/krs-522.050","next":"us-ky/krs-523.020"},"notice":"GroundRules: Original legal text.
