{"data":{"id":"us-ky/krs-525.085","jurisdiction":"us-ky","citation":"KRS 525.085","heading":"Dissemination of personally identifying information.","body":"(1) For the purposes of this section:\n(a) \"Dissemination\" means electronically publishing, posting, or otherwise\ndisclosing information to a public Internet site or public forum;\n(b) \"Household member\" means a person who regularly resides in the household\nor w ho within the six (6) months preceding the conduct of the offense\nregularly resided in the household;\n(c) \"Immediate family member\" means a parent, grandparent, spouse, child,\nstepchild, father -in-law, mother -in-law, son -in-law, daughter -in-law, sibling,\nbrother-in-law, sister-in-law, or grandchild; and\n(d) \"Personally identifying information\" means information that identifies or\nreasonably can be used to identify an individual, including but not limited to:\n1. Social Security number or other government-issued identifier;\n2. Date of birth;\n3. Home or physical address;\n4. Electronic-mail address or telephone number;\n5. Financial account number or credit or debit card number;\n6. Biometric, health, or medical data, or insurance information; or\n7. School or employment locations.\n(2) A person is guilty of disseminating personally identifying information about another\nperson when, with the intent to intimidate, abuse, threaten, harass, or frighten a\nperson who resides in the Commonwealth, he or she:\n(a) Intentionally disseminates the personally identifying information of the person\nor a person's immediate family member or household member; and\n(b) The dissemination would cause a reasonable person to be in fear of physical\ninjury to himself or herself, or  to his or her immediate family member or\nhousehold member.\n(3) This section shall apply to electronic communications originating within or\naccessible within the Commonwealth.\n(4) Disseminating personally identifying information is a Class A misdemeanor, u nless\nthe dissemination results in:\n(a) Physical injury to the victim or to a victim's immediate family member or\nhousehold member, in which case it is a Class D felony;\n(b) Serious physical injury to the victim or to a victim's immediate family\nmember or household member, in which case it is a Class C felony; or\n(c) Death of the victim or of a victim's immediate family member or household\nmember, in which case it is a Class B felony.\n(5) Nothing in this section shall be construed to impose liability on a  broadband\nInternet access service provider, a telecommunications service provider, an\ninterconnected VoIP provider, or a mobile service provider as defined in 47 U.S.C.\nsec. 153, a commercial mobile service provider as defined in 47 U.S.C. sec. 332(d),\nor a cable operator as defined in 47 U.S.C. sec. 522, when acting in its capacity as a\nprovider of those services.","path":["KRS Chapter 525"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51727","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:04Z","sha256":"da1959fd273877b92765f5145e625f98244c5d7899620a1fb4189be6aea8f359","source_id":"us-ky","stale":false,"prev":"us-ky/krs-525.080","next":"us-ky/krs-525.090"},"notice":"GroundRules: Original legal text.
