{"data":{"id":"us-ky/krs-527.200","jurisdiction":"us-ky","citation":"KRS 527.200","heading":"Use of a weapon of mass destruction in the first degree.","body":"(1) A person is guilty of use of a weapon of mass destruction in the first degree when\nhe or she intentionally, without lawful authority, places a weapon of mass\ndestruction at any location in the Commonwealth and, as a result, any person other\nthan the defendant is killed or receives serious physical injury.\n(2) A weapon of mass destruction is used with lawful authority if it is used with the\nwritten permission of an agency of the Commonwealth or of a city, county, charter\ncounty, or urban-county government having jurisdiction over the use of destructive\ndevices as defined in KRS 237.030 or the use of explosives.\n(3) Use of a weapon of mass destruction in the first degree is a Class A felony unless a\nperson other than the defendant is killed as a result, in whi ch case it is a capital\noffense.","path":["KRS Chapter 527"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19966","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:04Z","sha256":"0555343bb4716520d1700b49d4c4ecce07f5c4d7c55904f59cfda737ca07dcf6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-527.110","next":"us-ky/krs-527.205"},"notice":"GroundRules: Original legal text.
