{"data":{"id":"us-ky/krs-527.205","jurisdiction":"us-ky","citation":"KRS 527.205","heading":"Use of a weapon of mass destruction in the second degree.","body":"(1) A person is guilty of use of a weapon of mass destruction in the second degree when\nintentionally, without lawful authority, he or she:\n(a) Places a weapon of mass destruction at any location in the Commonwealth\nand, as a result, any person other than the defendant receives physical injury;\nor\n(b) Places a weapon of mass destruction on:\n1. The real property or any building of any public or private elementary or\nsecondary school, vocational school, or institution of postsecondary\neducation;\n2. A school bus or other vehicle owned, operated, or leased by a school;\n3. The real property or any building, public or private, that is the site of an\nofficial school-sanctioned function; or\n4. The real property or any building owned or leased by a government\nagency,\nand no person dies or receives any physical injury.\n(2) A weapon of mass destruction is used with lawful authority if it is used with the\nwritten permission of an agency of the Commonwealth or of a city, county, charter\ncounty, or urban-county government having jurisdiction over the use of destructive\ndevices as defined in KRS 237.030 or the use of explosives.\n(3) Use of a weapon of mass destruction in the second degree is a Class B felony.","path":["KRS Chapter 527"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19967","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:04Z","sha256":"023e69b2e13e22d3daf7eb4dc20f09d08a079890e4519649e065441cbd6f1e7b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-527.200","next":"us-ky/krs-527.210"},"notice":"GroundRules: Original legal text.
