{"data":{"id":"us-ky/krs-529.090","jurisdiction":"us-ky","citation":"KRS 529.090","heading":"Person convicted required to submit to screening for HIV infection --","body":"Prostitution or procuring prostitution with knowledge of sexually transmitted\ndisease or HIV.\n(1) Any person convicted of prostitution or procuring another to commit prostitution\nunder the provisions of KRS 529.020 shall be required to undergo screening for\nhuman immunodeficiency virus infection under direction of the Cabinet for Health\nand Family Services and, if infected, shall submit to treatment and counseling as a\ncondition of r elease from probation, community control, or incarceration.\nNotwithstanding the provisions of KRS 214.420, the results of any test conducted\npursuant to this subsection shall be made available by the Cabinet for Health and\nFamily Services to medical person nel, appropriate state agencies, or courts of\nappropriate jurisdiction to enforce the provisions of this chapter.\n(2) Any person who commits prostitution and who, prior to the commission of the\ncrime, had tested positive for a sexually transmitted disease and knew or had been\ninformed that he had tested positive for a sexually transmitted disease pursuant to\nKRS 214.410 and that he could possibly communicate such disease to another\nperson through sexual activity is guilty of a Class A misdemeanor. A person may be\nconvicted and sentenced separately for a violation of this subsection and for the\nunderlying crime of prostitution.\n(3) Any person who commits, offers, or agrees to commit prostitution by engaging in\nsexual activity in a manner likely to transmit th e human immunodeficiency virus\nand who, prior to the commission of the crime, had tested positive for human\nimmunodeficiency virus and knew or had been informed that he had tested positive\nfor human immunodeficiency virus and that he could possibly communi cate the\ndisease to another person through sexual activity is guilty of a Class D felony. A\nperson may be convicted and sentenced separately for a violation of this subsection\nand for the underlying crime of prostitution.\n(4) Any person convicted of procur ing another to commit prostitution in a manner\nlikely to transmit the human immunodeficiency virus and who, prior to the\ncommission of the crime, had tested positive for human immunodeficiency virus\nand knew or had been informed that he had tested positive  for human\nimmunodeficiency virus and that he could possibly communicate the disease to\nanother person through sexual activity is guilty of a Class D felony.","path":["KRS Chapter 529"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=19992","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:04Z","sha256":"b7473ca94dba252165d79179908bc37fb1fe22d764cc641086f3c8bf7d83d342","source_id":"us-ky","stale":false,"prev":"us-ky/krs-529.080","next":"us-ky/krs-529.100"},"notice":"GroundRules: Original legal text.
