{"data":{"id":"us-ky/krs-529.160","jurisdiction":"us-ky","citation":"KRS 529.160","heading":"Expungement of records relating to violation of chapter when person","body":"charged or convicted was a victim of human trafficking at time of offense --\nMotion -- Finding -- Presumption.\n(1) When a person is charged or convicted under this chapter, or with an  offense which\nis not a violent crime as defined in KRS 17.165, and the person's participation in the\noffense is determined to be the direct result of being a victim of human trafficking,\nthe person may make a motion in the court in which the charges were filed to\nexpunge all records of the offense.\n(2) The motion shall be filed no sooner than sixty (60) days following the date the final\njudgment was entered by the court in which the charges were filed.\n(3) (a) A motion filed under this section, any hearin g conducted on the motion, and\nany relief granted are governed by KRS 431.076, 431.078, and 431.079 unless\notherwise provided in this section.\n(b) For the purposes of expungement under KRS 431.076, a finding by the court\nthat the person's participation in the offense was a direct result of being a\nvictim of human trafficking shall deem the charges as dismissed with\nprejudice.\n(c) No official determination or documentation is required to find that the\nperson's participation in the offense was a direct result  of being a victim of\nhuman trafficking, but documentation from a federal, state, local, or tribal\ngovernmental agency indicating that the defendant was a victim at the time of\nthe offense shall create a presumption that the defendant's participation in th e\noffense was a direct result of being a victim.","path":["KRS Chapter 529"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43287","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"8f6df454ab82d3e8216690ed1b0a595902de3d1386c11250441b861dc4746ed6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-529.150","next":"us-ky/krs-529.170"},"notice":"GroundRules: Original legal text.
