{"data":{"id":"us-ky/krs-531.090","jurisdiction":"us-ky","citation":"KRS 531.090","heading":"Voyeurism.","body":"(1) A person is guilty of voyeurism when:\n(a) He or she intentionally:\n1. Uses or causes the use of any camera, videotape, photooptical,\nphotoelectric, or other image recording device for the purpose of\nobserving, viewing, photographing, filming, or videotaping the sexual\nconduct, genitals, an underga rment worn without being publicly visible,\nor nipple of the female breast of another person without that person's\nconsent; or\n2. Uses the unaided eye or any device designed to improve visual acuity for\nthe purpose of observing or viewing the sexual conduct , genitals, an\nundergarment worn without being publicly visible, or nipple of the\nfemale breast of another person without that person's consent; or\n3. Enters or remains unlawfully in or upon the premises of another for the\npurpose of observing or viewing t he sexual conduct, genitals, an\nundergarment worn without being publicly visible, or nipple of the\nfemale breast of another person without the person's consent; and\n(b) The other person is in a place where a reasonable person would believe that\nhis or her sexual conduct, genitals, undergarments, or nipple of the female\nbreast will not be observed, viewed, photographed, filmed, or videotaped\nwithout his or her knowledge.\n(2) The provisions of subsection (1) of this section shall not apply to:\n(a) A law enforcement officer during a lawful criminal investigation; or\n(b) An employee of the Department of Corrections, the Department of Juvenile\nJustice, a private prison, a local jail, or a local correctional facility whose\nactions have been authorized for security or investigative purposes.\n(3) Unless objected to by the victim or victims of voyeurism, the court on its own\nmotion or on motion of the Commonwealth's attorney shall:\n(a) Order the sealing of all photographs, film, videotapes, or other images that are\nintroduced into evidence during a prosecution under this section or are in the\npossession of law enforcement, the prosecution, or the court as the result of a\nprosecution under this section; and\n(b) At the conclusion of a prosecution under this section, unle ss required for\nadditional prosecutions, order the destruction of all of the photographs, film,\nvideotapes, or other images that are in possession of law enforcement, the\nprosecution, or the court.\n(4) Voyeurism is a Class A misdemeanor.","path":["KRS Chapter 531"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43301","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"9f0e3becacc399e850a5aefc749342e8d169e4892e2ec2a1e265c1db2f80c84f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-531.080","next":"us-ky/krs-531.100"},"notice":"GroundRules: Original legal text.
