{"data":{"id":"us-ky/krs-531.305","jurisdiction":"us-ky","citation":"KRS 531.305","heading":"Treatment in criminal or civil proceeding of property or material","body":"portraying child pornography or a sexual performance by a minor.\n(1) In a criminal or civil proceeding, any property or material that portrays child\npornography or a sexual perfo rmance by a minor as defined in this chapter shall\nremain secured or locked in the care, custody, and control of a law enforcement\nagency, or the prosecutor. Any property or material that portrays child pornography\nor a sexual performance by a minor shall not be filed with or stored by the court\nunless introduced as an exhibit for trial. Storage of trial court exhibits portraying\nchild pornography or a sexual performance by a minor shall be in accordance with a\ncourt order.\n(2) Notwithstanding any other law  or rule of court, a court shall deny, in any\nproceeding, any request by the defendant to copy, photograph, duplicate, or\notherwise reproduce any property or material that portrays a sexual performance by\na minor or constitutes child pornography so long as  law enforcement, the\nprosecutor, or the court, if the matter was introduced as an exhibit at trial, makes the\nproperty or material reasonably available to the defendant.\n(3) For the purposes of this section, property or material shall be deemed reasonably\navailable to the defendant if the prosecutor provides ample opportunity at a\ndesignated facility for the inspection, viewing, and examination of the property or\nmaterial that portrays a sexual performance by a child or constitutes child\npornography by the  defendant, his or her attorney, or any individual whom the\ndefendant uses as an expert during either the discovery process or a court\nproceeding.","path":["KRS Chapter 531"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47503","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"f1203aa09164aef79edc23a705bc9c808317de87d74217339efc47fb3e9bcf93","source_id":"us-ky","stale":false,"prev":"us-ky/krs-531.300","next":"us-ky/krs-531.306"},"notice":"GroundRules: Original legal text.
