{"data":{"id":"us-ky/krs-532.029","jurisdiction":"us-ky","citation":"KRS 532.029","heading":"Persistent violent felony offender sentencing.","body":"(1) As used in this section, \"violent felony\" means a felony that would classify a person\nas a violent offender under KRS 439.3401.\n(2) Notwithstanding any other provision of this chapter, a person convicted of a violent\nfelony who has previously been convicte d of two (2) separate violent felonies shall\nbe sentenced to:\n(a) A term of imprisonment for life without benefit of probation or parole, if the\nfelony is not a capital offense; or\n(b) Death, or a term of imprisonment for life without benefit of probation  or\nparole, if the felony is a capital offense.\n(3) For the purpose of determining whether a person has two (2) or more separate\nviolent felony convictions, two (2) or more convictions for which the person served\nconcurrent or uninterrupted consecutive ter ms of imprisonment shall be deemed to\nbe only one (1) conviction, unless one (1) of the convictions was for an offense\ncommitted while that person was imprisoned.","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55435","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"094b54ba649c925de5816c380dc80c9e5ac06a2c81870f6457dd615c523a9299","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.025","next":"us-ky/krs-532.030"},"notice":"GroundRules: Original legal text.
