{"data":{"id":"us-ky/krs-532.060","jurisdiction":"us-ky","citation":"KRS 532.060","heading":"Sentence of imprisonment for felony -- Postincarceration supervision.","body":"(1) A sentence of imprisonment for a felony shall be an indeterminate sentence, the\nmaximum of which shall be fixed within the limits provided by subsection (2) of\nthis section, and subject to modification by the trial judge pursuant to KRS 532.070.\n(2) Unless otherwise provided by law, the authorized maximum terms of imprisonment\nfor felonies are:\n(a) For a Class A felony, not less than twenty (20) years nor more than fifty  (50)\nyears, or life imprisonment;\n(b) For a Class B felony, not less than ten (10) years nor more than twenty (20)\nyears;\n(c) For a Class C felony, not less than five (5) years nor more than ten (10) years;\nand\n(d) For a Class D felony, not less than one (1) year nor more than five (5) years.\n(3) For any felony specified in KRS Chapter 510 or KRS 529.100, 529.110, 530.020,\n530.064(1)(a), 531.310, 531.320, 531.335, or 531.340, the sentence shall include an\nadditional five (5) year period of postincarceratio n supervision which shall be\nadded to the maximum sentence rendered for the offense. During this period of\npostincarceration supervision, if a defendant violates the provisions of\npostincarceration supervision, the defendant may be reincarcerated for:\n(a) The remaining period of his or her initial sentence, if any is remaining; and\n(b) The entire period of postincarceration supervision, or if the initial sentence\nhas been served, for the remaining period of postincarceration supervision.\n(4) In addition to the penalties provided in this section, for any person subject to a\nperiod of postincarceration supervision pursuant to KRS 532.400 his or her\nsentence shall include an additional one (1) year period of postincarceration\nsupervision following release from incarceration upon expiration of sentence if the\noffender is not otherwise subject to another form of postincarceration supervision.\nDuring this period of postincarceration supervision, if an offender violates the\nprovisions of supervision, the offender ma y be reincarcerated for the remaining\nperiod of his or her postincarceration supervision.\n(5) The actual time of release within the maximum established by subsection (1) of this\nsection, or as modified pursuant to KRS 532.070, shall be determined under\nprocedures established elsewhere by law.","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54992","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"ac947781b7df050951161ab760a30f2e0d2e53ad12d69d8881a76ca079478fb4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.055","next":"us-ky/krs-532.070"},"notice":"GroundRules: Original legal text.
