{"data":{"id":"us-ky/krs-532.130","jurisdiction":"us-ky","citation":"KRS 532.130","heading":"Definitions for KRS 532.135 and 532.140.","body":"(1) An adult, or a minor under eighteen (18) years of age who may be tried as an adult,\nconvicted of a crime and subject to sentencing, is referred to in this section and\nKRS 532.135 and 532.140 as a defendant.\n(2) A defendant with significant subaverage intel lectual functioning existing\nconcurrently with substantial deficits in adaptive behavior and manifested during\nthe developmental period is referred to in KRS 532.135 and 532.140 as a defendant\nwith a serious intellectual disability. \"Significantly subavera ge general intellectual\nfunctioning\" is defined as an intelligence quotient (I.Q.) of seventy (70) or below.\n(3) A defendant is referred to in KRS 532.135 and 532.140 as a defendant with serious\nmental illness if:\n(a) At the time of the offense, he or she has active symptoms and a documented\nhistory, including a diagnosis, of one (1) or more of the following mental\ndisorders using the most recent edition of the Diagnostic and Statistical\nManual of Mental Disorders published by the American Psychiatric\nAssociation:\n1. Schizophrenia;\n2. Schizoaffective disorder;\n3. Bipolar disorder; or\n4. Delusional disorder; and\n(b) The disorder is not manifested primarily by repeated criminal conduct or\nattributable solely to the acute effects of the voluntary use of alcohol  or other\ndrugs.\nAs used in this subsection, a documented history and diagnosis shall be from a\nmental health professional as defined in KRS 645.020(7)(a) to (d).","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52770","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:05Z","sha256":"672d247fa6f6e4e0c2e70dc9a07e91969ab40d5e930b7eb0bb871a7ac3d8543b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.120","next":"us-ky/krs-532.135"},"notice":"GroundRules: Original legal text.
