{"data":{"id":"us-ky/krs-532.245","jurisdiction":"us-ky","citation":"KRS 532.245","heading":"Credit for time spent in pretrial home incarceration.","body":"(1) Time spent in pretrial home incarceration pursuant to KRS 431.517 shall be\ncredited against the maximum term of imprisonment assessed to the defendant upon\nconviction. Notwithstanding KRS 532.200, a defendant who spent time in pretrial\nhome incarceration p ursuant to KRS 431.517 shall not be required to have\nparticipated in a global positioning monitoring system program to receive credit.\nTime credited under this section shall be calculated in accordance with KRS\n532.120.\n(2) Violation of the terms of pretri al home incarceration shall be deemed an\ninterruption of the defendant's home incarceration. The interruption shall begin at\nthe time of the violation and shall continue until a court revokes home incarceration\nor otherwise acts on the violation. Time spent in pretrial home incarceration prior to\nthe violation shall be credited against the maximum term of imprisonment assessed\nto the defendant upon conviction for the original charge.\n(3) This section shall apply to defendants sentenced on or after July 12, 2012.","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52895","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"d01cd2b33212484728c9b3f734c801f5735730ef8a570cc5f53709c9f5aa7cb1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.240","next":"us-ky/krs-532.250"},"notice":"GroundRules: Original legal text.
