{"data":{"id":"us-ky/krs-532.260","jurisdiction":"us-ky","citation":"KRS 532.260","heading":"Home incarceration or conditional release for certain Class C or Class D","body":"felons -- Eligibility -- Consequence of violation -- Administrative regulations.\n(1) Any Class C or Class D felon who is serving a sentence in a state -operated prison,\ncontract f acility, or county jail shall, at the discretion of the commissioner, be\neligible to serve the remainder of his or her sentence outside the walls of the\ndetention facility under terms of home incarceration or conditional release to an\nappropriate housing a lternative specified by KRS 532.262 using an approved\nmonitoring device as defined in KRS 532.200, if the felon:\n(a) 1. Has not been convicted of, pled guilty to, or entered an Alford plea to a\nviolent felony as defined by the Department of Corrections classification\nsystem; or\n2. Has not been convicted of, pled guilty to, or entered an Alford plea to a\nsex crime as defined in KRS 17.500;\n(b) Has nine (9) months or less to serve on his or her sentence;\n(c) Has voluntarily participated in a discharge plannin g process with the\ndepartment to address his or her:\n1. Education;\n2. Employment, technical, and vocational skills;\n3. Housing, medical, and mental health needs; and\n4. Criminal risk factors; and\n(d) Has needs that may be adequately met in the community wh ere he or she will\nreside upon release.\n(2) A person who is placed under terms of home incarceration pursuant to subsection\n(1) of this section shall remain in the custody of the Department of Corrections. Any\nunauthorized departure from the terms of home incarceration may be prosecuted as\nan escape pursuant to KRS Chapter 520 and shall result in the person being returned\nto prison.\n(3) The Department of Corrections shall promulgate administrative regulations to\nimplement the provisions of this section.","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39561","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"47bf5583eae1e34ffd4ea4e97116c2a1058d7de377147aeff01a066791f08b4e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.250","next":"us-ky/krs-532.262"},"notice":"GroundRules: Original legal text.
