{"data":{"id":"us-ky/krs-532.400","jurisdiction":"us-ky","citation":"KRS 532.400","heading":"Postincarceration supervision -- Violation -- Exclusions.","body":"(1) In addition to the penalties authorized by law, any person who:\n(a) Is convicted of a capital offense or a Class A felony;\n(b) Has a maximum or close security classification as defined by administrative\nregulations promulgated by the department; or\n(c) Is not eligible for parole by statute;\nshall be subject to a period of postincarceration supervision following release from\nincarceration upon expiration of sentence or completion of parole.\n(2) The period of postincarceration supervision shall be one (1) year.\n(3) During the period of postincarceration supervision, the defendant shall:\n(a) Be subject to all orders specified by the Department of Corrections; and\n(b) Comply with all education, treatment, testing, or combination thereof required\nby the Department of Corrections.\n(4) Persons under postincarceration supervision pursuant to this section shall be subject\nto the supervision of the Division of Probation and Parole and under the authority of\nthe Parole Board.\n(5) If a person violates a provision specif ied in subsection (3) of this section, the\nviolation shall be reported in writing by the Division of Probation and Parole.\nNotice of the violation shall be sent to the Parole Board to determine whether\nprobable cause exists to revoke the defendant's postin carceration supervision and\nreincarcerate the defendant as set forth in KRS 532.060.\n(6) The provisions of this section shall not apply to a person who is subject to the\nprovisions of KRS 532.043.\n(7) The provisions of this section shall apply only to persons convicted, pleading guilty,\nor entering an Alford plea for an offense committed after June 8, 2011.","path":["KRS Chapter 532"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39554","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"1603a053928c95ba9eb297680852d43640cdc86011a43bcf68ec82923bb462a4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-532.358","next":"us-ky/krs-533.010"},"notice":"GroundRules: Original legal text.
