{"data":{"id":"us-ky/krs-533.025","jurisdiction":"us-ky","citation":"KRS 533.025","heading":"Rate of payment by department to county for incarceration of persons in","body":"jail -- Payment of work release fees to jailer and deduction from department's\npayment -- Department's custody of prisoner for specified medical conditions.\n(1) When a person is convicted of, pleads guilty to, or enters an Alford plea to a felony\noffense and is sentenced to jail as a condition of conditional discharge or as a\ncondition of probation, the Department of Corrections shall pay for the\nincarceration of that person i n a jail at the same rate and under the same conditions\nas for a Class D felon who is incarcerated in the jail under KRS 532.100.\n(2) If a person incarcerated in a jail on conditional discharge or probation under\nsubsection (1) of this section is granted w ork release, he or she shall pay the work\nrelease fees required by law to the jailer. The amount of work release fees paid by a\nprisoner shall be deducted from the amount which the Department of Corrections\nshall pay for the incarceration of that prisoner.\n(3) The Department of Corrections may, during the prisoner's period of incarceration in\nthe jail, take custody of the prisoner and hold that person in a state prison facility for\nthe purpose of treating the following medical conditions:\n(a) Chronic heart and lung conditions;\n(b) Psychiatric conditions;\n(c) Acute medical conditions that require diagnostic testing or hospitalization;\n(d) Acute surgical conditions;\n(e) Pregnancy; or\n(f) Any other medical condition which the Department of Corrections may set out\nby administrative regulation.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49965","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"e43452793abf94ca16300096d844a7d7cb68f0f2e26fb615916cfbc02153f802","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.020","next":"us-ky/krs-533.030"},"notice":"GroundRules: Original legal text.
