{"data":{"id":"us-ky/krs-533.252","jurisdiction":"us-ky","citation":"KRS 533.252","heading":"Requirements of Commonwealth's attorney when considering application","body":"for pretrial diversion.\nWhen considering an application for pretrial diversion, the attorney for the\nCommonwealth shall:\n(1) Have a criminal record check made to ascertain if the per son is eligible for pretrial\ndiversion.\n(2) Interview the victim of the crime, if there is an identified victim, and, when the\nvictim of the crime is deceased or the attorney for the Commonwealth deems it\nnecessary, interview a member of the family of the victim of the crime. The attorney\nfor the Commonwealth shall explain to the victim the diversion program, the\nproposed diversion conditions, and any other matters that the attorney for the\nCommonwealth deems to be appropriate. The results of the interview and\nrecommendations of the victim may be presented to the court when it is considering\nthe application for pretrial diversion. If the application for diversion is approved by\nthe court, the approval shall be in open court and may be attended by the victim and\nthe victim's family. The attorney for the Commonwealth shall attempt to notify\nthem of this fact and the time, date, and place of the hearing.\n(3) Conduct any other investigation that the attorney for the Commonwealth determines\nmay be necessary with r egard to the defendant and the circumstances of the crime\nso as to enable him or her to set proper conditions of pretrial diversion, or to make a\ndecision whether to recommend pretrial diversion.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20089","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"2df52e25d725d8ce7c2845ec720320d92f01bfbde3e02349a0f09b3b7d4030b0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.251","next":"us-ky/krs-533.254"},"notice":"GroundRules: Original legal text.
