{"data":{"id":"us-ky/krs-533.278","jurisdiction":"us-ky","citation":"KRS 533.278","heading":"Treatment -- Case management.","body":"(1) Upon initiation of treatment, the designated behavioral health treatment provider\nmay assign a case manager in accordance with criteria established by the Cabinet of\nHealth and Family Services in administrative regulations promulgated under KRS\nChapter 13A. The case manager, or the treatment provider if no case manager has\nbeen assigned, shall notify the Office of Adult Education within the Department of\nWorkforce Development of the Education and Labor Cabinet of the individual's\nparticipation in a behavioral health conditional dismissal program.\n(2) Any assigned case manager, working in collaboration with the individual referred\nfor treatment and the treatment team and provider, or the treatment provider if there\nis no case manager, shall:\n(a) Obtain all releases from the individual served that may be required to confirm\ncompliance with the program requirements;\n(b) Coordinate all services and testing required under the program, including\ntransportation if needed and available;\n(c) Receive and maintain copie s of all necessary documentation to ensure\ncompliance with the program requirements, including but not limited to:\n1. Treatment records;\n2. Drug tests;\n3. Educational assessments and advancements, if applicable;\n4. Employment status and employment training;\n5. Community service, if applicable; and\n6. Housing status;\n(d) Meet or conference with providers of any program requirements on a regular\nbasis to address the participant's progress, including restitution, and any\nrequired adjustment that may be needed to the participant's program; and\n(e) Provide periodic progress reports to the attorney for the Commonwealth and\nthe attorney for the participant according to the following schedule:\n1. An initial report within fourteen (14) days of the initiation of treatment;\n2. A follow-up report within twenty-eight (28) days after submission of the\ninitial fourteen (14) day report;\n3. Subsequent reports on a quarterly basis throughout the course of\ntreatment beginning April 15, 2023, with reports due thereafter on\nJanuary 15, April 15, July 15, and October 15 of each year of the\nparticipation in the pilot program; and\n4. A final report within thirty (30) days of the successful completion of the\nprogram.\n(3) Any assigned case manager, treatment provider, or member of the treatment team, is\nencouraged to:\n(a) Utilize digital notification or reminder services for participants throughout the\ntreatment program period; and\n(b) If digital services under paragraph (a) of this subsection are utilized, include in\neach quarterly report required under subsection (2)(e) of this section the\nfollowing data:\n1. The number of participants;\n2. The type of digital services provided;\n3. The costs of providing the digital services;\n4. Health and social outcomes from the use of the digital services; and\n5. Any other information pertaining to outcomes related to the use of the\ndigital services.\n(4) The treatment provider shall:\n(a) Recommend modifications to the treatment prog ram to the attorney for the\nCommonwealth, and the attorney for the participant;\n(b) Review the individual's progress and recommend continued participation in\nthe program or dismissal from the program due to an inability or\nunwillingness to meet the terms and conditions of the program;\n(c) Immediately report dismissal from the treatment program based upon lack of\ncompliance with the terms and conditions of the program to the attorney for\nthe Commonwealth, the court, and the attorney for the participant; and\n(d) Advise the attorney for the Commonwealth, the court, the attorney for the\nparticipant, and the victim, if there is an identified victim, of the participant's\nsuccessful completion of the program requirements.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53188","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"4708dcb74417fb8f2f95e94b7ae4f7ad0e976a07c73a6c5407d4ef8eff942722","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.276","next":"us-ky/krs-533.280"},"notice":"GroundRules: Original legal text.
