{"data":{"id":"us-ky/krs-533.280","jurisdiction":"us-ky","citation":"KRS 533.280","heading":"Completion of program -- Effect -- Notice to identified victim.","body":"(1) Upon successful completion of the behavioral health conditional dismissal program:\n(a) The court shall dismiss the charged offense or offenses with prejudice and\ndischarge the defendant;\n(b) All records relating to the case, including but not limited to ar rest records and\nrecords relating to the charges, shall be sealed, except as provided in KRS\n27A.099;\n(c) The offense shall be accessible for review for the sole purpose of determining\nthe defendant's eligibility for deferred prosecution under KRS 218A.1415; and\n(d) The defendant shall not be required to disclose the arrest or other information\nrelating to the charges or participation in the program on an application for\nemployment, credit, or other type of application unless required to do so by\nstate or federal law.\n(2) If a defendant who is participating in the behavioral health conditional dismissal\nprogram is convicted of or enters a plea of guilty to a felony offense other than a\nqualifying offense under any law of the United States, this state, or any  other state,\nthat was committed while participating in the program, the defendant shall be\ndischarged from the behavioral health conditional dismissal program for failure to\ncomply with the terms and conditions.\n(3) If the defendant is discharged from the  behavioral health conditional dismissal\nprogram by the treatment provider under KRS 533.278, all statements or other\ndisclosures made by the defendant to any provider while participating in the\nprogram shall be protected by all applicable privacy laws and professional standards\nregarding confidentiality and shall not be admissible in a criminal trial relating to\nthe offenses covered by the agreement executed under KRS 533.276.\n(4) The attorney for the Commonwealth shall notify the victim, if there is an id entified\nvictim, of the defendant's dismissal from the program for noncompliance or\ndischarge from the program following successful completion of the program.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53189","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"7538882dfe053bf076cc693c3d29a7ef4216f8dde3bd25dd3417da7e69acf0b9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.278","next":"us-ky/krs-533.282"},"notice":"GroundRules: Original legal text.
