{"data":{"id":"us-ky/krs-533.286","jurisdiction":"us-ky","citation":"KRS 533.286","heading":"Vocational assessment -- Individualized employment plan.","body":"(1) (a) The Office of Adult Education within the Department of Workforce\nDevelopment of the Education and Labor Cabinet, in conjunction with a\ncommunity rehabilitation provider, shall conduct an in-person initial screening\nof any individual participating in a beha vioral health conditional dismissal\nprogram within thirty (30) days of a participant beginning the program under\nKRS 533.276.\n(b) Nothing in this section shall prohibit any department, office, or division of the\nEducation and Labor Cabinet from entering in to an agreement with a third\nparty in each county participating in the pilot program to provide the services\nrequired under this section.\n(2) The initial screening shall include:\n(a) Educational history, including highest school grade completed, and when;\n(b) Employment history, including types and lengths of employments;\n(c) Military history, if any;\n(d) The participant's physical, mental, and emotional abilities and limitations;\n(e) Aptitude, skill level, and interest testing;\n(f) An assessment of language skills; and\n(g) A determination of whether further assessment is needed to develop the\nvocational component of the recovery treatment program. If further\nassessment is required, it shall be completed within the first ninety (90) days\nfollowing entry into the recovery treatment program unless additional time is\nneeded to provide for physical recovery from the effects of a severe behavioral\nhealth disorder.\n(3) Within ten (10) days of completion of the vocational assessment, the Office of\nAdult Education, i n consultation with the behavioral health conditional dismissal\nprogram provider, shall establish an individualized plan designed to attain a specific\nemployment outcome to include:\n(a) Specific educational goals with identification of institutions from wh ich the\nparticipant will receive educational credits or training;\n(b) Specific job -skills training, and the facility or institution from which the\nparticipant will receive the job-skills training, to include:\n1. A holistic education curriculum that includes but is not limited to\nproblem solving, communication skills, and interpersonal skills; and\n2. Sector-specific employers as designated by the Kentucky Workforce\nInnovation Board;\n(c) The required number of hours  per week the participant will be engaged in\neducational or vocational training, including anticipated study time or\nassigned projects completion time outside of the classroom or training facility;\n(d) The specific services that will be provided through th e Department of\nWorkforce Development to achieve the employment outcome, overcome or\nminimize any identified obstacles to employment, and the frequency with\nwhich those services will be provided, including but not limited to access to\nservices during nontraditional business hours and support;\n(e) The beginning and projected completion date of each service;\n(f) If supported employment training or services are to be provided outside of the\nEducation and Labor Cabinet, the identification of the provider of the\nextended services and the reporting and accountability requirements\nestablished with the program provider;\n(g) The criteria established for evaluating progress and success;\n(h) The attendance and reporting requirements established for the participant and\nfor the institution or facility providing the service, including to whom and\nwith what frequency reports are to be made;\n(i) The date the employment plan is estimated to be completed;\n(j) The job-placement assistance plan that will be provided to the parti cipant by\nthe department;\n(k) The need for ongoing or future training following completion of the\nemployment plan and the availability of that training to the participant; and\n(l) The continuum of care to be provided by a community rehabilitation provider.\n(4) The Department of Workforce Development, in consultation with the Kentucky\nHigher Education Assistance Authority, shall provide the participant with assistance\nin securing all scholarships, grants, or other available financial assistance to ensure\naccess to the educational or training requirements needed to achieve the specific\nemployment outcome.\n(5) The Department of Workforce Development may establish an electronic registry to\nbe used by participants in the behavioral conditional dismissal program, treatment\nplan providers, and prospective employers to assist in matching program\nparticipants with employment opportunities.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53192","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"c384b4cb1056467e6b31e8ffe49404e1c9a341eca9d1e2f74e6cd3b20ffd8752","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.284","next":"us-ky/krs-533.288"},"notice":"GroundRules: Original legal text.
