{"data":{"id":"us-ky/krs-533.288","jurisdiction":"us-ky","citation":"KRS 533.288","heading":"Behavioral Health Conditional Dismissal Program Implementation","body":"Council -- Membership -- Meetings -- Duties.\n(1) The Behavioral Health Conditional Dismissal Program Implementation Council is\ncreated for the purpose of assisting with the implementation of the behavioral health\nconditional dismissal pilot program created under KRS 533.272.\n(2) The membership of the council shall include the following:\n(a) The executive director of the Office of Drug Control Policy, or his or her\ndesignee, who shall serve as chair of the council;\n(b) The director of the Administrative Office of the Courts, or his or her designee;\n(c) The commissioner of the Department for Behavioral Health, Developmental\nand Intellectual Disabilities, or his or her designee;\n(d) The commissioner of the Kentucky Department for Medicaid Services, or his\nor her designee;\n(e) The public advocate, or his or her designee;\n(f) A member of the Kentucky Commonwealth's Attorneys' Association, elected\nby its membership;\n(g) A member of the Kentucky County Attorneys Association;\n(h) One (1) Circuit Judge, elected by the Circuit Judges Association of Kentucky;\n(i) One (1) District Judge, elected by the District Judges Association of\nKentucky;\n(j) The executive director of the Office of Adult Education, or his or her\ndesignee;\n(k) The executive director of the Kentucky Jailers Association, or his or her\ndesignee; and\n(l) Two (2) individuals selected by the Kentucky Association of Regional\nPrograms, one (1) of whom shall be in recovery from a substance use disorder\nand one (1) of whom is being treated or has been treated for a mental health\ndisorder as defined in KRS 533.270.\n(3) The council shall meet at least quarterly. Meetings shall be held at the call of the\nchair, or upon the written request of two (2) members to the chair.\n(4) The council shall:\n(a) Oversee the implementation of the behavioral health conditional dismissal\nprogram pilot project; and\n(b) Review the data collected by the Administrative Office of the Courts and\nreport to the Interim Joint Committee on Judiciary and the Governor by\nOctober 1 of each year of the pilot project regarding:\n1. Recommendations for any additional performance measures needed to\npromote the success of the program;\n2. Whether any action is necessary, including funding or legislation;\n3. Recommendations for resolving any matters that reduce the\neffectiveness of the program; and\n4. Any additional information the council deems appropriate.\n(5) Members shall not receive any additional compensation for their service on the\ncouncil but shall be reimbursed for all necessary expenses.\n(6) The council shall be attached to the Justice and P ublic Safety Cabinet for\nadministrative purposes.\n(7) The council shall terminate December 31, 2031, unless extended by the General\nAssembly.","path":["KRS Chapter 533"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"76de2c0629f6f52aba41d2089ac8e39233f4cb07d3f562758c344a6434426cc4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-533.286","next":"us-ky/krs-533.290"},"notice":"GroundRules: Original legal text.
