{"data":{"id":"us-ky/krs-56.062","jurisdiction":"us-ky","citation":"KRS 56.062","heading":"Inspection -- Notice -- Asbestos agency account.","body":"(1) The cabinet shall cause an inspection to be made of all buildings owned, leased or\noperated by the Commonwealth for the presence of friable materials.  If friable\nmaterials are found as a result of such inspection, the cabinet shall have samples of\nthe fri able materials analyzed for asbestos in accordance with testing methods\nestablished by the Environmental Protection Agency, as provided in 40 CFR\n763.109 as amended.\n(2) When friable asbestos -containing materials are identified in a state building, a\nnotice shall be conspicuously posted on each entrance to the building informing the\nusers of the building of their presence.  The notice shall include the following\nwarning:\nWARNING: THIS BUILDING HAS BEEN INSPECTED FOR FRIABLE\n(EASILY CRUMBLED) MATERIALS WHI CH CONTAIN ASBESTOS.\nFRIABLE ASBESTOS -CONTAINING MATERIALS MAY CAUSE HEALTH\nPROBLEMS AND ARE PRESENT IN THIS BUILDING. A RECORD OF THE\nINSPECTION AND A DIAGRAM OF THE LOCATION OF FRIABLE\nASBESTOS-CONTAINING MATERIALS ARE AVAILABLE IN ROOM ----- OF\nTHIS BUILDING.\n(3) The cabinet shall provide to all persons employed in state buildings found to\ncontain friable asbestos -containing materials a written notice of the location, by\nroom or building area, of all friable asbestos-containing materials in the building.\n(4) When friable asbestos -containing materials are not found as a result of inspection,\nthe following notice shall be conspicuously posted on each entrance to the building:\nTHIS BUILDING HAS BEEN INSPECTED FOR FRIABLE (EASILY\nCRUMBLED) MATERIALS WHICH CONTAIN ASBESTOS.  FRIABLE\nASBESTOS-CONTAINING MATERIAL MAY CAUSE HEALTH PROBLEMS.\nTHIS BUILDING DOES NOT CONTAIN FRIABLE ASBESTOS -CONTAINING\nMATERIALS.\n(5) When inspections identify asbestos -containing material that is not friable, the\ncabinet shall caus e an annual inspection of the building to be made to determine if\nthe asbestos-containing material has become friable.\n(6) When inspections identify asbestos in a building which has been enclosed or\nencapsulated to prevent its spread, a notice shall be posted in the custodial offices of\nthe building informing maintenance personnel of the location of such materials.\n(7) When asbestos-containing materials have been removed from a building, any notice\npreviously posted in such building pursuant to this section  regarding the asbestos -\ncontaining materials so removed may be removed.\n(8) Expenditures required to implement this section may be paid from the asbestos\nagency account established within the Finance and Administration Cabinet.","path":["KRS Chapter 56"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:10Z","sha256":"f88352e01410e54822d9275462ce3d6f739859b855b80e67e139d336a48b16f7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-56.060","next":"us-ky/krs-56.063"},"notice":"GroundRules: Original legal text.
