{"data":{"id":"us-ky/krs-56.770","jurisdiction":"us-ky","citation":"KRS 56.770","heading":"Definitions for KRS 56.770 to 56.784.","body":"As used in KRS 56.770 to 56.784, unless the context requires otherwise:\n(1) \"Aggregate simple payback period\" means the simple payback period of a set of\nenergy conservation measures taken together for a building;\n(2) \"Building\" means all contiguous land, structures, appurtenances, and improvements\nthat use utilities;\n(3) \"Cabinet\" means the Finance and Administration Cabinet;\n(4) \"Energy audit\" means examination of a building's utility -using systems, utilities\nconsumption and costs, occupancy patterns, and  operation and maintenance\nprocedures;\n(5) \"Energy conservation measure\" means any construction, process, improvement,\nrepair, alteration, or betterment of a building or other state property that is intended\nto reduce utility consumption or operational cos t; or any equipment, fixture, or\nfurnishing to be added to or used in a building that will be a cost -effective utility-\nrelated project that is intended to reduce utility consumption or operational costs;\n(6) \"Guaranteed energy savings performance contract\"  means an agreement for the\nprovision of energy services or equipment, energy conservation measures and\nalternate energy technologies for state government buildings or other state property,\nin which a person agrees to design, construct, install, maintain, operate, or manage\nenergy systems or equipment to improve energy efficiency of, or produce energy in\nconnection with, a state government building. Payments for a guaranteed energy\nsavings performance contract shall be made from measured and verified saving s\ngenerated from implementation of the energy conservation measures financed by\nthe contract. The term of a guaranteed energy savings performance contract shall\nnot exceed the life of the energy savings generated from implementation of the\nenergy conservation measures financed by the contract. If the measured and verified\nsavings are not sufficient to pay the financial obligations under the contract, the\ncontractor is liable for the contract payments;\n(7) \"High-performance building\" means a public building that is designed, constructed,\nand capable of being operated in a manner that:\n(a) Increases environmental performance and economic value over time;\n(b) Safeguards the health of occupants;\n(c) Enhances satisfaction and productivity of workers through energy -\nefficient systems;\n(d) Incorporates environmentally friendly materials and products; and\n(e) Reduces waste;\n(8) \"High-performance building standards\" means a set of standards developed by the\ncabinet pursuant to KRS 56.777;\n(9) \"Engineering analysis\" means a detailed cost -benefit analysis of energy efficiency\ninvestments including a review of potential cost savings through operation and\nmaintenance changes;\n(10) \"Life-cycle cost analysis\" mean s a method for estimating the total cost of an\nenergy-using component or building over its useful life, including cost factors such\nas purchase price or construction, renovation, or leasing costs, energy use,\nmaintenance, interest, and inflation;\n(11) \"Low cost/no cost energy conservation measures\" means those energy saving\npractices and energy conservation measures, usually involving operation and\nmaintenance practices, that can be accomplished by existing personnel within\nexisting operating budgets;\n(12) \"Simple payback period\" means the number of years it takes to pay back, from\nestimated savings, the initial cost of an energy conservation measure with the\nsimple payback period equal to the initial cost divided by the estimated annual\nsavings;\n(13) \"Savings\" means the reduction in expenditures, excluding any state government and\npost-secondary education personnel expenditures, that are measured and verified,\nincluding but not limited to energy usage, operating costs, and capital cost\navoidance that occur a s a result of the implementation of energy conservation\nmeasures;\n(14) \"Capital cost avoidance\" means savings generated when expenditures of\nappropriated capital construction or appropriated capital outlay funds are avoided\nbecause the budgeted capital imp rovements or items of equipment are contained\nwithin the energy conservation measures provided by a guaranteed energy savings\nperformance contract;\n(15) \"Operating costs\" means expenditures associated with operating and maintaining a\nproperly functioning b uilding and its systems including but not limited to the\nheating, ventilation, cooling, lighting, plumbing, water heating, electrical, and\nlaundry systems and their controls;\n(16) \"Public building\" has the same meaning as in KRS 318.010;\n(17) \"ENERGY STAR\" means the voluntary program administered by the United States\nEnvironmental Protection Agency and the United States Department of Energy that\nis designed to protect the environment through the promotion of energy -efficient\nproducts and practices;\n(18) \"Green Globes rating system\" means the on -line environmental assessment tool\ndeveloped by the Green Building Initiative as of December, 2004, that allows\ndesigners, property owners, and managers to evaluate and rate buildings against\nbest sustainable building  design practices and integrate principles of sustainable\narchitecture at every stage of project delivery in order to design and construct\nbuildings that will be energy -efficient and resource -efficient, achieve operational\nsavings, and provide healthier environments in which to live and work; and\n(19) \"LEED\" means the building rating systems developed on or after January 1, 2005,\nby the United States Green Building Council that allow designers, property owners,\nand managers to evaluate and rate buildings against best sustainable building design\nand practices and to integrate principles of sustainable architecture at every stage of\nproject delivery in order to design and construct buildings that will be energy -\nefficient and resource -efficient using a whole -building approach in five (5) key\nareas of human and environmental health:\n(a) Sustainable site development;\n(b) Water savings;\n(c) Energy efficiency;\n(d) Material selection; and\n(e) Environmental quality.","path":["KRS Chapter 56"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43274","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:11Z","sha256":"6844fbe0dc4146a8b3902db5a2e3021d59ea6d8747a479b06d16bd4d91a60adf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-56.760","next":"us-ky/krs-56.772"},"notice":"GroundRules: Original legal text.
