{"data":{"id":"us-ky/krs-56.777","jurisdiction":"us-ky","citation":"KRS 56.777","heading":"High-Performance Buildings Advisory Committee -- Membership -- Duties -","body":"- Administrative regulations -- Resource utilization.\n(1) A High-Performance Buildings Advisory Committee is hereby created and shall be\nadministratively staffed by the cabinet.\n(2) The committee shall consist of sixteen (16) members and shall include:\n(a) A representative of the cabinet designated by the secretary;\n(b) A representative of the Tourism, Arts and Heritage Cabinet designated by the\nsecretary;\n(c) A representati ve of the Department of Education designated by the\ncommissioner;\n(d) A representative of the Council on Postsecondary Education designated by the\npresident;\n(e) A representative of the Office of Energy Policy designated by the executive\ndirector; and\n(f) A representative appointed by the Governor from each of the following:\n1. The design and construction industry involved in public works\ncontracting;\n2. The Kentucky Chapter of the U. S. Green Building Council;\n3. The University of Kentucky College of Design;\n4. The Kentucky Forest Industries Association;\n5. The Kentucky Society of the American Institute of Architects;\n6. The American Society of Heating, Refrigerating, and Air -Conditioning\nEngineers;\n7. The Associated General Contractors of Kentucky;\n8. The West Kentucky Construction Association;\n9. The Kentucky Manufactured Housing Institute;\n10. The Kentucky Ready Mixed Concrete Association; and\n11. The Plantmix Asphalt Industry of Kentucky.\n(3) The representative of the cabinet shall serve as the chair person of the committee.\nAll appointments shall be for a term of two (2) years. Committee members shall\nserve until their successors are appointed and shall be eligible for reappointment.\n(4) The committee shall meet at least monthly or as convened by the chairperson.\n(5) The members of the committee shall receive reimbursement for the cost of travel to\nand from the meetings and any costs necessarily incurred in carrying out their\nduties.\n(6) The committee shall:\n(a) Consult with architects, engineers, buil ders, energy and conservation\norganizations, and other interested stakeholders, and make recommendations\nto the cabinet regarding:\n1. Standards and benchmarks developed under existing high -performance\nbuilding programs, including the ENERGY STAR rating sys tem, Green\nGlobes rating system, and Leadership in Energy and Environmental\nDesign (LEED) Green Building rating system; and\n2. Standards and guidelines developed and adopted by the U.S. Green\nBuilding Council, the American Society of Heating, Refrigerating  and\nAir-Conditioning Engineers, and the Illuminating Engineering Society of\nNorth America partnership concerning the design of sustainable\nbuildings to balance environmental responsibility, resource efficiency,\noccupant comfort and well-being, and community sensitivity;\n(b) Assist the cabinet in the review of state building projects to ensure that\nbuilding performance and efficiency are maximized to the extent\neconomically feasible using a life-cycle cost analysis;\n(c) Assist the cabinet in developing a pr ocess of documentation of the attainment\nof high-performance building standards; and\n(d) Assist the cabinet in conducting an ongoing professional development\nprogram for state and local building designers, construction companies, school\ndistricts, building  managers, and the general public on high -performance\nbuilding design, construction, maintenance, and operation.\n(7) Prior to the implementation of KRS 56.770 to 56.784, the cabinet shall promulgate\nadministrative regulations pursuant to KRS Chapter 13A ne cessary to implement\nthis section. The cabinet shall consider the recommendations made by the High -\nPerformance Buildings Advisory Committee pursuant to subsection (6) of this\nsection and shall establish the criteria for the high -performance building standa rds\nand the benchmarks by which the high -performance building standards will be\nmeasured. At a minimum, the cabinet shall:\n(a) Include the standards for site selection and management, water efficiency,\nenergy conservation, waste reduction, material and res ource use, and indoor\nair quality; and\n(b) Require that each high -performance building be designed, constructed, or\nrenovated so that it is capable of being rated as an ENERGY STAR building\nin accordance with the criteria and rating system adopted by the U nited States\nEnvironmental Protection Agency and in effect at the time the building is\ndesigned or, in the case of leased buildings, at the time the lease is entered\ninto on or after July 1, 2018.\n(8) In developing the criteria for the high -performance building standards, the cabinet\nshall consider and encourage the use of:\n(a) Locally grown lumber from forest lands implementing sustainable practices\nestablished by the American Tree Farm System's Sustainable Forest Initiative\nor the Kentucky Forest Stewards hip Program established under KRS 149.330\nto 149.355;\n(b) Building materials manufactured with recycled content within the\nCommonwealth; and\n(c) Renewable energy sources.","path":["KRS Chapter 56"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47521","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:11Z","sha256":"fac19cf33762411168e7025149b39103a5fc47a8410f2632f2841ccf6cdae86b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-56.776","next":"us-ky/krs-56.778"},"notice":"GroundRules: Original legal text.
