{"data":{"id":"us-ky/krs-56.784","jurisdiction":"us-ky","citation":"KRS 56.784","heading":"Guaranteed energy savings performance contracts -- Authority for","body":"administrative regulations.\n(1) Each agency responsible for managing state -owned property shall review the utility\nusage of the property and shall cooperate with the cabinet to determine which\nproperties are good candidates for guaranteed energy savings performance contracts.\nThe responsible agency is encouraged to implement guaranteed energy savings\nperformance contracts where appropriate.\n(2) The cabinet may implement the provisions of K RS 56.770 to 56.784 through the\npromulgation of administrative regulations pursuant to KRS Chapter 13A.\n(3) The secretary of the cabinet shall promulgate administrative regulations in\naccordance with the provisions of KRS Chapter 13A establishing a process  for\nprocurement of energy savings performance contracts, including required contract\nlanguage. The following entities shall adhere to these regulations when procuring\nservices under a guaranteed energy savings performance contract:\n(a) Any governing body of a postsecondary institution that manages its capital\nconstruction program under KRS 164A.580; or\n(b) Any public corporation as defined by KRS 45.750(2)(c) or as created under\nthe Kentucky Revised Statutes as a governmental agency and instrumentality\nof the Commonwealth that manages its capital construction program.\n(4) All state agencies, including those identified in subsection (3) of this section, shall\nsubmit proposed guaranteed energy savings performance contracts to the Office of\nFinancial Management within the Office of the Controller for review and approval\nprior to contract execution.\n(5) The secretary shall report all authorized guaranteed energy savings performance\ncontracts to the Capital Projects and Bond Oversight Committee for its review.","path":["KRS Chapter 56"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22694","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:11Z","sha256":"a0f7d0b81511a6dbc256abd81424696b401d84a9aad7a8f5e655e3fb08caf571","source_id":"us-ky","stale":false,"prev":"us-ky/krs-56.783","next":"us-ky/krs-56.790"},"notice":"GroundRules: Original legal text.
