{"data":{"id":"us-ky/krs-57.390","jurisdiction":"us-ky","citation":"KRS 57.390","heading":"Unsolicited mailings by state agencies -- Publications to be submitted to","body":"Legislative Research Commission and General Assembly online.\n(1) As used in this section:\n(a) \"Publication\" means any annual or biennial report, book, pamphlet,\nnewsletter, bulle tin, map, calendar, or brochure, of a documentary or\ninformational nature, whether or not required by statute. The term does not\ninclude news releases; notices, agendas, or minutes of meetings; or budgets\nand budget recommendations; and\n(b) \"State agency\" means any executive branch organizational unit or\nadministrative body, as defined in KRS 12.010, or any agency of the\nlegislative branch of state government.\n(2) A state agency shall not mail a publication to any person who has not requested a\ncopy of the publication unless the unsolicited mailing is:\n(a) Used to market or advertise an agency, event, site, program, or service; or\n(b) Determined, in writing, to be essential to the performance of the agency's\nstatutory mission by:\n1. The Governor, if the state agency is in the executive branch; or\n2. The General Assembly or the Legislative Research Commission, if the\nstate agency is in the legislative branch.\n(3) The Governor may delegate responsibility under subsection (2) of this section to the\nsecretaries o f the program cabinets for publication of state agencies within or\nattached to their respective cabinets.\n(4) If any provision of the Kentucky Revised Statutes requires a state agency to submit\na publication annually or biennially to the Legislative Resear ch Commission or to\nthe General Assembly, the state agency shall submit that publication online rather\nthan on paper or by means of any other printed medium.","path":["KRS Chapter 57"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39689","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:13Z","sha256":"1f31118a7ad9e1988ba16bd113fbb20060c9463d4ab1c394de9d2e9a74550025","source_id":"us-ky","stale":false,"prev":"us-ky/krs-57.380","next":"us-ky/krs-57.990"},"notice":"GroundRules: Original legal text.
