{"data":{"id":"us-ky/krs-6.761","jurisdiction":"us-ky","citation":"KRS 6.761","heading":"Conflict of interest provisions -- Penalty.","body":"(1) A legislator shall not intentionally participate in the discussion of a question in\ncommittee or on the floor of the General Assembly, vote, or make a decision in his\nofficial capacity on any matter:\n(a) In which he, or any member of his family, or the legislator's business associate\nwill derive a direct monetary gain or suffer a direct monetary loss as a result of\nhis vote or decision; or\n(b) Which relates specifically to a business in which he owns or controls an\ninterest of ten thousand dollars ($10,000)  or more, or an interest of more than\nfive percent (5%).\nViolation of this provision is a Class D felony. The provisions of this subsection\nnotwithstanding, a legislator may vote on legislation affecting his salary, expenses,\nbenefits, and allowances, as provided by law. The provisions of this subsection\nnotwithstanding, a legislator may participate in the discussion of the question in\ncommittee and on the floor of the General Assembly, vote, or make a decision on a\nmatter if any benefit or detriment which  accrues to the member of the General\nAssembly, as a member of a business, profession, occupation, or other group, or to a\nmember of his family or a business interest specified in subsection (1)(b) of this\nsection is of no greater extent than the benefit o r detriment which accrues generally\nto other members of the business, profession, occupation, or other group;\n(2) A legislator who has a personal or private interest in a bill proposed or pending\nbefore the General Assembly shall be subject to the limitati ons of Section 57 of the\nConstitution of Kentucky, which provides that the legislator shall disclose his\ninterest to the house of which he is a member and refrain from voting upon pain of\nexpulsion. A member shall disclose his interest by filing a disclosure statement with\nthe clerk or by a verbal announcement to the body.\n(3) The right of legislators to represent their constituencies, however, is of such major\nimportance that legislators should be barred from voting on matters of direct\npersonal interest only in clear cases and if the matter is particularly personal.","path":["KRS Chapter 6"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=378","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:25Z","sha256":"feb4040acb64fa2ef5bf6e280d5eb4e3cb35618a525f0dcf5a95eacb70ef7d34","source_id":"us-ky","stale":false,"prev":"us-ky/krs-6.760","next":"us-ky/krs-6.764"},"notice":"GroundRules: Original legal text.
