{"data":{"id":"us-ky/krs-605.102","jurisdiction":"us-ky","citation":"KRS 605.102","heading":"Caregiver of committed child to use reasonable and prudent parent","body":"standard for child's participation in age or developmentally appropriate\nactivities -- Limitation of liability -- Cabinet official's immunity  not\nabrogated  or  diminished  --  Cabinet  and  caregiver  to  verify\nappropriateness of child's application for operator's license or permit --\nRequest  for cancellation --  Administrative regulation.\n(1) For the purposes of this section, \"caregiver\" has the same meaning as in 42\nU.S.C. sec. 675(10)(B).\n(2) In accordance with 42 U.S.C. sec. 671, a caregiver shall use the reasonable\nand  prudent parent standard to determine whether to allow a child in the\ncustody of the cabinet to participate in an age or developmentally appropriate\nextracurricular, enrichment, or social activity.\n(3) A  caregiver shall not be liable as a result of the caregiver's approval of the\nparticipation of a child who  is in the custody of the cabinet in an age or\ndevelopmentally appropriate activity, so  long as  the caregiver acts in\naccordance with the reasonable and prudent parent standard. No provision in\nany  agreement  between  the cabinet and  a caregiver shall diminish the\nstandard of care as set forth by this statute.\n(4) Nothing in this section is intended to abrogate or diminish the immunities of a\ncabinet official acting in the course and  scope  of the cabinet official's\nemployment or create a legal duty on the part of a cabinet official.\n(5) The  cabinet, in conjunction with the child's caregiver, shall utilize the\nreasonable and prudent parent standard to:\n(a) Verify that a child is in the custody of the cabinet and is age or\ndevelopmentally appropriate to apply for an operator's license, motorcycle\noperator's license, intermediate license, or any instruction permit in\naccordance with KRS 186.450 or 186.470; or\n(b) Request that a child's operator's license, motorcycle license, intermediate\nlicense, or any instruction permit be cancelled in accordance with KRS\n186.470.\n(6) The  cabinet shall promulgate an  administrative regulation to implement\nsubsection (5) of this section.","path":["KRS Chapter 605"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T21:00:06Z","sha256":"8a1633e02a50b5dbebfb1726261da4adf661073e8a169d4674e3730ab0c825ca","source_id":"us-ky","stale":false,"prev":"us-ky/krs-605.100","next":"us-ky/krs-605.110"},"notice":"GroundRules: Original legal text.
