{"data":{"id":"us-ky/krs-61.080","jurisdiction":"us-ky","citation":"KRS 61.080","heading":"Incompatible offices.","body":"(1) No person shall, at the same time, be a state officer, a deputy state officer, or a\nmember of the General Assembly, and an officer of any county, city, consolidated\nlocal government, or other municipality, or an employee thereof.\n(2) The offices of justice of the peace, county judge/executive, surveyor, sheriff, deputy\nsheriff, coroner, constable, jailer, and clerk or deputy clerk of a court, shall be\nincompatible, the one (1) with any of the others. The office of county\njudge/executive and county school superintendent are incompatible.\n(3) No person shall, at the same time, fill a county office and a municipal office.\nNotwithstanding the fact that consolidated local governments have both municipal\nand county powers, persons who hold the office of mayor or l egislative council\nmember of a consolidated local government shall not thereby be deemed to hold\nboth a county office and a municipal office. Officers of consolidated local\ngovernments shall not, at the same time, fill any other county or municipal office.\n(4) No person shall, at the same time, fill two (2) municipal offices, either in the same\nor different municipalities.\n(5) No person shall, at the same time, fill any two (2) appointed offices of special\npurpose governmental entities, as defined in KRS 65 A.010, that each have the\nauthority to levy taxes.\n(6) No person shall, at the same time, fill any state office and an appointed office of a\nspecial purpose governmental entity that has the authority to levy taxes, unless a\nstate statute specifically requi res a person holding a state office to serve in an\nappointed office of a special purpose governmental entity that has the authority to\nlevy taxes.\n(7) The following offices shall be incompatible with any other public office:\n(a) Member of the Public Service Commission of Kentucky;\n(b) Member of the Workers' Compensation Board;\n(c) Commissioner of the fiscal court in counties containing a city of the first\nclass;\n(d) County indexer;\n(e) Member of the legislative body of cities of the first class;\n(f) Mayor a nd member of the legislative council of a consolidated local\ngovernment; and\n(g) Mayor and member of the legislative body in cities of the home rule class.\n(8) No office in the Kentucky active militia shall be incompatible with any civil office\nin the Commonwealth, either state, county, district, or city.\n(9) Service as a volunteer firefighter in a volunteer fire department district or fire\nprotection district fo rmed pursuant to KRS Chapter 65, 75, 95, or 273 shall not be\nincompatible with any civil office in the Commonwealth, whether state, county,\ndistrict, or city.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43611","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:14Z","sha256":"cdad034e3afcc27e23f604c2c43164d0f6d7b54be8880242d84d86ae343f40af","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.070","next":"us-ky/krs-61.090"},"notice":"GroundRules: Original legal text.
