{"data":{"id":"us-ky/krs-61.170","jurisdiction":"us-ky","citation":"KRS 61.170","heading":"Malfeasance or neglect of county officers -- Penalty.","body":"(1) County judges/executive, justices of the peace, sheriffs, coroners, surveyors, jailers,\ncounty attorneys, and constables may be indicted in the county in which they reside\nfor misfeasance or malfeasance in office, or willful neglect in the discharge of\nofficial duties, and if convicted they shall be fined not less than one hundred ($100)\nnor more than one thousand dollars ($1,000), and the judgment of conviction shall\ndeclare the office held by such person vacant.\n(2) Any sheriff, deputy sheriff, policeman,  or other peace officer who fails to enforce\nany provision of KRS Chapter 242 after receiving information of a violation\nthereof, or having knowledge of a violation thereof and failing to act thereon, may\nbe indicted for nonfeasance or malfeasance in offic e, and if convicted shall be fined\nnot less than fifty ($50) nor more than two hundred dollars ($200), and the\njudgment of conviction shall declare the office held by such person vacant.\n(3) In the absence of good cause shown, a member of the fiscal court who fails to attend\nfifty percent (50%) of the regular terms of the fiscal court within a six (6) month\nperiod or who fails to attend two (2) consecutive terms of the fiscal court shall be\ncharged with neglect of office and upon conviction shall forfeit his office.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22899","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:14Z","sha256":"0d0dbd54250b23e88a834aba8785db5163a2ba6343393eef3540cb066f77a31b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.169","next":"us-ky/krs-61.180"},"notice":"GroundRules: Original legal text.
