{"data":{"id":"us-ky/krs-61.390","jurisdiction":"us-ky","citation":"KRS 61.390","heading":"Facsimile signatures and seals on certain public securities -- Options.","body":"(1) Any bonds heretofore or hereafter authorized to be issued by the state, any county,\nmunicipality, taxing or school district, including any corporation acting as an\nagency or instrumentality of such unit, whether created by statute, or organized\nunder the provisions of the nonprofit corporation laws, under the provisions of any\nlaw heretofore or hereafter enacted and any interest coupons attached thereto may, if\nso authorized by the governing body of such unit, bear or be executed with the\nfacsimile signature of any official authorized by such law to sign or to execute such\nbonds or coupons. In case any such law shall provide for the sealing of such bonds\nwith the official or corporate seal of such unit or of its governing body or any\nofficial thereof, a facs imile of such seal may be imprinted on the bonds if so\nauthorized by the governing body of such unit, and it shall not be necessary in such\ncase to impress such seal physically upon such bonds.\n(2) In case any such law shall provide that bonds issued there under shall be negotiable,\nsuch bonds shall be offered for sale as negotiable bonds, payable to bearer, with or\nwithout attached coupons for the payment of interest and with or without privilege\nof registration as to principal only, or registration as to b oth principal and interest,\nas the governing body of the issuing unit may determine; but such governing body\nmay nevertheless additionally provide, in its discretion, that any purchaser of all or\nany of such bonds shall have a right and privilege to design ate, subject to such\nconditions and restrictions as the governing body may prescribe, that such bonds, or\nany of them, be issued in the first instance in fully registered nonnegotiable form, or\nin one (1) or more denominations of such purchaser's own choos ing, or both,\nwhether in negotiable or nonnegotiable form, with or without attached coupons,\nwith or without registration provision, and with or without rights of conversion or\nreconversion from one (1) form and denomination to another, at the option of th e\nholder or holders from time to time.\n(3) In case any officer whose signature or a facsimile of whose signature shall appear\non any bonds or coupons shall cease to be such officer before the delivery of such\nbonds, such signature or such facsimile shall nevertheless be valid and sufficient for\nall purposes the same as if he had remained in office until such delivery, and any\nbond may bear the facsimile signature of, or may be signed by, such persons as at\nthe actual time of the execution of such bond shall  be the proper officers to sign\nsuch bond although at the date of such bond such persons may not have been such\nofficers.\n(4) The words \"public securities\" as used herein shall mean bonds, notes or other\nobligations for the payment of money issued by this state, by its political\nsubdivisions, or by any department, agency or other instrumentality of this state or\nof any of its political subdivisions.\n(5) This section shall not repeal any other law authorizing the execution of public\nsecurities with facsimile signatures or seals.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22935","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:14Z","sha256":"e7f9e12a26dad0c2aec798b5bf6756c3ac1b0523de5c1c5e70e34abdcf2b4da5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.387","next":"us-ky/krs-61.392"},"notice":"GroundRules: Original legal text.
