{"data":{"id":"us-ky/krs-61.405","jurisdiction":"us-ky","citation":"KRS 61.405","heading":"Use of excess fees by county sheriff or county clerk for health insurance or","body":"health maintenance organization coverage.\n(1) For the purpose of this section, \"excess fees\" means fees and commissions in an\namount greater than the total salaries and expens es that are required by law to be\npaid by an office.\n(2) Notwithstanding the provisions of KRS 64.530(3), a sheriff or county clerk whose\noffice earns excess fees during any fiscal year, and whose employees are not being\nprovided with health insurance or h ealth maintenance organization coverage by\ncounty government or by an agency of county government on the day that fiscal year\ncloses, may purchase health insurance or health maintenance organization coverage,\neffective within one (1) month after the close of the fiscal year, that will cover all\nemployees of the office, including the sheriff or county clerk if he desires, for at\nleast twelve (12) months.\n(3) The type and extent of the health insurance or health maintenance organization\ncoverage shall be dete rmined by the sheriff or county clerk.  The coverage shall be\nreasonable in relation to the amount of money available from the excess fees.\n(4) If a sheriff's or county clerk's office earns excess fees during any fiscal year, but the\nexcess fees are not su fficient, in the judgment of the sheriff or county clerk, to\nprovide employees with a reasonable degree of health insurance or health\nmaintenance organization coverage, the sheriff or county clerk may use a\ncombination of employee contributions and excess fees to purchase the insurance or\ncoverage.\n(5) A sheriff or county clerk may purchase health insurance or health maintenance\norganization coverage under this section in cooperation with any governmental unit\nor combination of units allowed to cooperativel y purchase coverage under KRS\n79.080.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=22941","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:14Z","sha256":"0c3fe1a17464d65ef5680153104782443b29f063dd2203c314d7b184388b88ba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.400","next":"us-ky/krs-61.407"},"notice":"GroundRules: Original legal text.
