{"data":{"id":"us-ky/krs-61.520","jurisdiction":"us-ky","citation":"KRS 61.520","heading":"Participation determined by board and fixed by executive order --","body":"Authority for order.\n(1) Each  department determined by the board to be eligible and qualified for\nparticipation shall participate in the system when the Governor by appropriate\nexecutive order, the authority to issue such executive order being granted,\ndirects such department to participate in the system. The effective date of such\nparticipation shall be determined by the board and fixed by the Governor in his\nexecutive order.\n(2) (a) Notwithstanding the provisions of subsection (1) of this section, the\nGovernor is authorized to permit any state college or university, which he\ndirects by appropriate executive order to participate in the system after\nJanuary  1, 1972, to include its noninstructional employees  in the\nmembership  of the system while excluding the instructional employees of\nthe state college or university from membership.\n(b) All employees of an agency participating under authority of paragraph (a)\nof this subsection shall be considered noninstructional employees except\nthe members  of the instructional staff as defined in KRS 61.510.\n(3) All executive orders issued under authority of this section since July 1, 1956,\nare hereby ratified by the General Assembly  and each participating and\ncontributing department, board, agency, corporation, board for mental health or\nindividuals with an intellectual disability, or entity participating since that date\nunder such executive order is hereby declared to be a participating department\nunder the Kentucky Employees Retirement System.\n(4) Except as provided by KRS 61.522:\n(a) Once  a department participates it shall continue to participate as long as\nit remains qualified; and\n(b) Any  position initially required to participate in the Kentucky Employees\nRetirement System shall continue to participate as long as the position\nexists.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:15Z","sha256":"d26808c670a823e375b5c585c77239b6d45a60f8f6b251fcc6d17221f8983372","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.515","next":"us-ky/krs-61.521"},"notice":"GroundRules: Original legal text.
