{"data":{"id":"us-ky/krs-61.546","jurisdiction":"us-ky","citation":"KRS 61.546","heading":"Sick leave for employees who began participating before January 1, 2014.","body":"(1) Except as otherwise provided by this section, any member of the Kentucky\nEmployees Retirement System or the State Police Retirement System whose\nretirement date is J uly 14, 1984, or thereafter, shall receive credit for unused sick\nleave accrued while contributing to the retirement system from which the retirement\nbenefit is to be paid in accordance with this section.\n(2) (a) Upon the member's notification of retiremen t as prescribed in KRS 16.576 or\n61.590, the employer shall certify the retiring member's unused, accumulated\nsick leave balance  to the system.\n(b) The member's sick leave balance, expressed in days, shall be divided by the\naverage number of working days per month in the state service and rounded to\nthe nearest number of whole months.\n(c) Except as provided by subsection (3) of this section, the member's sick leave\nbalance, expressed in months, shall upon retirement be added to his or her\nservice credit fo r the purpose of determining his or her annual retirement\nallowance under KRS 16.505 to 16.652 or 61.510 to 61.705 and for the\npurpose of determining whether the member is eligible to receive a retirement\nallowance under KRS 16.505 to 16.652 or 61.510 to 61.705.\n(3) For a member who begins participating in the Kentucky Employees Retirement\nSystem or the State Police Retirement System on or after September 1, 2008:\n(a) The member shall receive no more than twelve (12) months of service credit\nupon retirement for accumulated unused sick leave accrued while contributing\nto the retirement system or systems from which the retirement benefit is to be\npaid;\n(b) The service credited for accumulated unused sick leave as limited by this\nsection and added to the member 's service credit shall be used for purposes of\ndetermining the member's annual retirement allowance under KRS 16.505 to\n16.652 and 61.510 to 61.705; and\n(c) The service credited for accumulated unused sick leave and added to the\nmember's service credit sh all not be used to determine whether a member is\neligible to receive a retirement allowance under any of the provisions of KRS\n16.505 to 16.652 and 61.510 to 61.705.\n(4) Notwithstanding any other provision of this section to the contrary, the value of any\naccumulated sick leave that is added to the member's service credit in the Kentucky\nEmployees Retirement System or the State Police Retirement System on or after\nJuly 1, 2010, shall be paid to the retirement system by the last participating\nKentucky Employees Retirement System or State Police Retirement System\nemployer based upon a formula adopted by the board.\n(5) The provisions of this section shall not apply to a partic ipating agency whose\nemployees are not employed by the Commonwealth until the agency certifies to the\nsystem that a sick leave program has been formally adopted and is universally\nadministered within the agency.\n(6) This section shall not apply to members who begin participating in the systems\nadministered by Kentucky Retirement Systems on or after January 1, 2014.","path":["KRS Chapter 61"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54851","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:15Z","sha256":"cfbe6686e978269cbda4083645100e722dbd5074f2b8f9690e3ce2f107e15a79","source_id":"us-ky","stale":false,"prev":"us-ky/krs-61.545","next":"us-ky/krs-61.547"},"notice":"GroundRules: Original legal text.
